Bob’s Discount Furniture Goof Proof class action overview: 

  • Who: A Bob’s Discount Furniture customers is suing the company over its Goof Proof insurance policy
  • Why: The customer says Bob’s does not pay out insurance on its furniture when it should

Bob’s Discount Furniture often denies insurance claims for its Goof Proof insurance, even when the damage is clearly covered under the policy, a new class action lawsuit alleges. 

Plaintiff Kenneth Wong filed the class action lawsuit against Bob’s Discount Furniture LLC June 20 in a California federal court, alleging violations of state and federal consumer laws. 

He said the company sells furniture with added protection plans known as “Goof Proof” which is marketed as “the best way to protect your investment from a wide variety of accidents for 5 years.”

However, he alleges the company’s sale of discount furniture with added coverage only for accidental damage falls outside of a typical insurance service contract.

“Defendant denies claims based on customer misuse, even where that misuse may have occurred unintentionally, and is unexpected or unforeseen, which is the definition of an accident,” Wong says.

“In reality, Goof Proof does not protect the furniture purchased by Bob’s customers.”

Sofa and chair not covered under insurance

In Wong’s case, he bought a Jaxon sofa/chair combo for $749.00, and Goof Proof for $129.99, at Bob’s Discount Furniture in 2019.

In June 2020, Wong submitted claims for his sofa and chair, because the chair arm became deformed.

Bob’s Discount Furniture denied his claim, saying the damage didn’t happen accidentally, but rather through normal use. 

“Defendant’s denial of the claim on the chair’s arm because it was ‘not classified as

a customer-caused accident’ even though it ‘occurred from a single incident’ ‘during normal use of the item’ disregards that the breakage occurred due to the underlying faulty frame of the chair,” the lawsuit states. 

“To the extent coverage was denied based on damage occurring during ‘normal use’ of the chair, this is equivalent to a wear and tear exclusion.”

Wong is suing on behalf of all California customers who purchased Goof Proof.

He’s suing for breach of warranty, breach of California consumer laws, and for bad faith insurance denial. Wong is seeking certification of the class action, damages, an injunction, fees, costs and a jury trial. 

This is not the first class action lawsuit over this issue. In April, Bob’s Discount Furniture was hit with a class action lawsuit alleging it misled consumers about the quality of a couch with a reclining chair it sold and then failed to honor extended warranty claims when it prematurely broke.

    Purchase a couch and chair in 2020-2021. And this July 2023 a friend fell back and broke the frame. I have a five year plan with goof proof. Been denied 2× they’re saying normal wear and tear. Bull I have pictures they still look new. There is no children in the house. They are taking people money for nothing 🤬 something needs to be done about this.

    Someone fell on my couch and broke the frame. Had it for 2years still looks new. I have pictures. Been denied 2times. From goof proof. Angry 😡 as hell.

    Same thing happened to me! I got Goof Proof insurance for my dining room table and four chairs. First week I had the chairs my friend sat in one and the wooden frame broke. He is not a big man AT ALL. I called and they said that’s “normal use” and therefore won’t be covered! Ridiculous!

    Got Goof proof because I have 3 kids and 3 cats and two dogs. I figured it was a smart idea. IT WASN’T. My son is special needs. While sitting on the recliner he pulled himself up and broke a plastic piece. Goof Proof says this is “normal use” and denied the claim. I put another claim in for stains. My dog jumped on the table and knocked food and drink on the couch. This was voided because I used a sponge to try to clean up mess, no chemicals. This is terrible. Now I have to pay to get all this fixed.

    Having a lot of issues getting my claim approved with the Guardian company in charge with Goof proof claims. After several back and forth emails and replies about what exact pictures they are looking for the mechanical flaw of the reclining mechanism, they came back with a decision that it’s normal wear and tear of the furniture. It’s ludicrous that they are getting away with honoring their claim they cover workmanship flaw but instead insist in accidents that you stated but can still make decision that something is normal wear. If anything I want my refund back for all goof proof purchases I made in the years with Bobs.

    I am having an issue as well after we put in a claim stating the problem and don’t know how it happened (regarding the specific mechanics of the chair) they denied the claim saying “You don’t know what happened” LOL!

    Please add me to this class action lawsuit I would be delighted to sue their ass!

    I purchased a couple of SOFA-4283-03-BUFF/WNTR/STRLNG-CHARLESTON in August/September 2021 for $799.00 each + the cost of Goof Prof warranty.
    The sales people almost force you to purchase the goof proof warranty with wrong claims and advertisements. and when it comes to the service NO BODY is there to help you.
    The Sofa’s arms are made of cardboard paper and deformed after a few months. On April, 2023, the back frame of one of the sofas broke. After claiming “Ineligible for Service” finally some repairman came over on May 2, 2023 and he informed me that he has to get authorization for the work. Today, May 26 no call back and after waiting on the phone for hours without any answer.

    Bought ” goof proof ” from Bob’s on sectional and rug . trying to get a cleaning done , was told I could get a cleaning as much as I want with in the 5 yrs . I requested a whole cleaning , my claim got approved , than when cleaner came over I was told he was only authorized to do SPOTS !!!! WHAT ? I paid for cleaning warrenty !! Who cleans SPOTS. All or nothing . I can clean SPOTS . also 2 month wait to have a SPOT cleaning .
    OMG WOW !!!! I have another issue but I won’t get into that right now .

    Please add me to the list because our reclining couch has broken multiple times and instead of just giving us a voucher for a new couch they place orders to replace the pieces and we have to wait months before we have to call back to check on the part. When we reported the problem and spoke to the rep months after they said that the part was available but now it was back ordered when we had been waiting for almost a year for the couch. Additionally, our furniture came falling apart. Very bad customer service.

      And Guardian always denies our claim when we send it back in saying it’s not covered but they tell you at the store it is covered
