fitbit charge 2 fitness band on top of packagingA class action lawsuit claims that Fitbit Charge 2 smart fitness bands are prone to developing screen fractures but Fitbit refuses to offer repairs or refunds to customers who experience the defect.

Plaintiff Hillary Schneider says she bought a Fitbit Charge 2 for $149.99 only to have the display screen crack suddenly within months of use.

The Fitbit class action lawsuit states that Schneider contacted Fitbit and informed them about the cracked screen. She says Fitbit offered her a 25 percent discount on a replacement fitness band in order to remedy the situation.

According to the Fitbit fitness band class action, by not offering to repair or replace the product, Fitbit is in breach of implied warranty of merchantability.

Schneider alleges that she overpaid for the Fitbit Charge 2 since the crack “significantly diminishes” its worth. The plaintiff says she wouldn’t have paid nearly $150 for a fitness band that could spontaneously crack.

“Plaintiffs and the class members have consequently suffered actual economic damages as a result of Fitbit’s unlawful conduct,” the Fitbit Charge 2 class action lawsuit states.

The Fitbit class action lawsuit claims that the new display screen of the Fitbit Charge 2 was one of the primary appeals over the Charge HR.

In online promotional advertisements of the Fitbit Charge 2, the company states “The easy-to-read tap-sensitive display is four times larger than the original Fitbit Charge HR, so you can see more activity stats and keep your fitness goals on track with just a glance.”

The plaintiff says that once the aesthetic appeal of fitness band is destroyed, the product is “valueless or near-valueless.”

The Fitbit Charge 2 class action alleges that with a cracked screen, it also is difficult to get the “tap-sensitive display” to function properly.

Schneider claims that she isn’t the only Fitbit user to have experienced this defect. The Fitbit class action lawsuit points to several complaints on online forums.

“The screen cracked and it appears to be cracking from the inside. There was no impact to the watch, I didn’t drop it, it simply cracked right down the middle of the screen as though the screen is expanding or stretching and no longer fits the casing,” one complaint states.

In addition to experiencing the same issue, the Fitbit class action points out that other consumers are also given the mere option of a discount on a new Fitbit product when they complain about the screen defect.

Schneider seeks to represent all U.S. consumers who bought a new Fitbit Charge 2 smart fitness band that later developed a vertical crack down the center of the display screen. In addition, the plaintiff is seeking to represent an Illinois subclass.

The Fitbit user is represented by William M. Sweetnam and Natasha Singh of Sweetnam LLC.

The Fitbit Cracked Display Screen Class Action Lawsuit is Hillary Schneider v. Fitbit Inc., Case No. 1:19-cv-01322, in the U.S. District Court for the Northern District of Illinois, Eastern Division.

    My Fibit Charge 2 crack in the middle. They did sent me ONLY the body of the fit bit (That most probably is a refurbish one). But I still have to buy the band that is broken in the part that holds the body. In reality is a lot of money and at the end no one can’t tell you that it wont happen again with the refurbish piece.

    Mine cracked just a year after having it… it was very random on min I looked at it and it just had a few scratches from normal wear. But the next day when I woke up there was a crack. It wasnt hit on anything hard that could crack it either.

    Please add me to. Mine broke with in two years. My band broke couple of times. When it broke second time they said they couldn’t replace it cuz there is no warranty on the replacement band they provided when it broke first time. I’m done with firbit. Trying to explore other options.
