SlimFast class action lawsuit overview:

A new SlimFast class action lawsuit alleges the manufacturer misleads consumers about the amount of protein some of its meal replacement shake products contain.

Plaintiff Magali Cintron filed the lawsuit Aug. 2 against SlimFast manufacturer KSF Acquisition Corporation.

SlimFast class action says consumers rely on labels when purchasing meal replacement products

Consumers looking to purchase meal replacement products such as SlimFast shakes often rely on the product label to ensure the product provides a sufficient amount of protein. SlimFast products are fortified with processed protein sources that provide a more concentrated type of protein than milk, which also contains fats and carbohydrates, the SlimFast class action explains.

Cintron says she purchased two SlimFast products based on the representations on the package that prominently stated they contained 10g and 20g of protein.

The SlimFast Original Shake Mix, labeled as containing 10g of protein, only contains 2g of protein, according to the SlimFast class action lawsuit. 

The back of the label reportedly displays two nutrition facts columns. The first column lists the SlimFast product’s nutritional value, and the other lists the nutrition facts when the product is mixed with eight fluid ounces of fat free milk (which is sold separately). 

Similarly, the SlimFast Advanced Nutrition Smoothie Mixes and Advanced Immunity Orange Cream Swirl Smoothie list 20g of protein on the front label, but the nutrition facts indicate that the products without added milk contain only 12 grams of protein, the SlimFast class action lawsuit states.

SlimFast class action says FDA prohibits deceptive nutritional claims on front label

The SlimFast class action lawsuit points to U.S. Food and Drug Administration regulations that prohibit manufacturers from making nutritional claims on the front of a product label that are false or misleading. 

The FDA does allow manufacturers to include an “as prepared” column for food products that are typically mixed with other ingredients, but information about the food preparation must be prominently stated on the label, the SlimFast class action explains.

The SlimFast product labels allegedly contain symbols next to the protein representations, but “those symbols are barely legible, insufficiently offset by the much larger and prominent text that surrounds them and are lost within the other symbols” on the product label, Cintron says.

The SlimFast class action lawsuit asserts claims for breach of express warranty and violation of state consumer protection laws.

This is not the first time SlimFast has been targeted by a class action lawsuit. A consumer recently filed a class action lawsuit with similar protein content misrepresentation claims in California federal court. And a class action filed earlier this year alleges SlimFast product labels mislead consumers about the number of calories in some of its Keto Fat Bomb products.

    I’m not happy that they lied…..again another lie about the protein amount! I drink them because they are supposed to be good for me, added protein and they are NOT!
