Walgreens Class Action Says Graham Crackers Need More Honey

A recent Walgreens class action lawsuit claims that the company’s honey graham crackers contain only a tiny amount of real honey.

Walgreens sells their graham cracker products under their Nice! brand. The “Honey Grahams” products reportedly contain marketing statements on the front and back labeling, including the phrases, “Made with Real Honey,” “Simple,” “Honest” and “Delicious.”

According to the Walgreens class action lawsuit, most consumers assume that the graham cracker products are sweetened with honey based on packaging representations.

However, plaintiff Tina Brown claims these representations are false because honey is not the primary sweetener in the products. Instead, the graham crackers are allegedly sweetened “primarily with sugar and contain only [minuscule] amounts of honey.”

Brown says consumers are also misled about the flour content in Walgreens Honey Grahams. Although consumers assume that graham crackers contain graham flour, Walgreens’ Honey Grahams reportedly contain more refined flour than graham flour.

The Walgreens class action claims that the products are intentionally labeled in order to deceive consumers into believing that honey is the primary sweetener and that graham flour is a primary ingredient.

Although sugar is associated with health problems such as obesity and diabetes, honey is reportedly considered to be a healthier alternative by consumers.

Brown references survey results which reportedly found that “[c]onsumers rated honey at 73% ‘better for you than sugar,’” “93% of consumers consider honey to be a natural sweetener,” and “about half of consumers would pay at least 5% more for food bars, ready-to-drink tea, and yogurt primarily sweetened with honey.”

Likewise, graham flour is a whole grain flour product. Brown argues that consumers intentionally seek out products made with whole grains due to their high fiber content and healthy profile.

Between the low levels of honey and graham flour, Brown argues that she and other consumers were deceived by the products. They allegedly expected the Walgreens’ Honey Grahams to have a significant amount of honey and graham flour but did not receive the product they hoped for.

Brown claims that she and other consumers were willing to pay a higher price for the products based on representations that the Honey Grahams contained a significant amount of honey and graham flour.

The Walgreens class action lawsuit claims that consumers were financially injured because they were deceived into purchasing the products or paying a higher price.

“Had plaintiffs and class members known the truth, they would not have bought the Product or would have paid less for it,” Brown argues in her Walgreens class action lawsuit.

“Defendant’s false, deceptive, and misleading branding and packaging of the Product has enabled defendant to sell more of the Product and at higher prices per unit, than it would have in the absence of this misconduct, resulting in additional profits at the expense of consumers.”
