A class action lawsuit says that Blue Apron’s products were contaminated by Salmonella and claims that the company did not take proper steps to ensure that contamination did not occur.
The Blue Apron Salmonella contamination class action lawsuit was filed by Keefe Ferrandini against Blue Apron LLC, a retailer that sells food and meal preparation kits.
Ferrandini says that she purchased and received the “Dukkah-Spiced Beef and Couscous” from Blue Apron in or around November 2018. She says that she used and prepared the food as intended, and served it to her family.
On Nov. 27, 2018, Ferrandini reportedly received an email with the subject line “Sesame Tahini Supplier Recall.” Allegedly, the email said that “one of our suppliers is conducting a voluntary recall of its sesame tahini product due to the potential presence of Salmonella bacteria.” The email allegedly advised customers to contact their healthcare provider if they have any concerns.
The Blue Apron Salmonella class action lawsuit says that Blue Apron did not offer any refund for the meals provided that may have been contaminated with Salmonella. Ferradini says that the company also did not warn of potential Salmonella contamination and the dangers of consuming contaminated food.
Ferradini claims that the “Dukkah-Spiced Beef and Couscous” contained the tahini that was potentially contaminated, and therefore, the meal was not fit for consumption as intended. Allegedly, the defective food was a safety hazard.
Ferradini says that she was caused distress and anxiety because of the letter and risk of contamination. Allegedly, Blue Apron should have foreseen this distress.
The Blue Apron Salmonella contamination class action lawsuit says that Ferradini and many other customers who received allegedly contaminated meals were injured by Blue Apron because their health was put at risk, and because they were caused distress by the letter sent by Blue Apron. The Blue Apron class action lawsuit say that blue Apron had a “willful and/or conscious disregard for the safety and rights” of its customers.
Ferradini seeks damages on behalf of herself and all similarly affected customers from California. She also seeks disgorgement of profits gained form the sale of the allegedly contaminated foods.
Allegedly, the company violated the California Consumer Legal Remedies Act by misrepresenting the food as safe and of a high standard when it was potentially contaminated by Salmonella and was therefore unusable.
The Blue Apron contamination class action lawsuit also says that Blue Apron breached implied warranty by selling contaminated food — allegedly, the implied warranty was that the food was safe to use and eat as advertised. Allegedly, Blue Apron knew or should have known how the food would be used, but the food was not fit for the use.
