lenny and larry's complete cookie packageLenny & Larry’s vegan cookie company and a group of customers are seeking approval of a modified $2.3 million class action settlement that will provide more cash and free cookies to Class Members.

Initially the vegan cookie company offered $1.85 million in cash payments and $3.15 million in free cookies as a part of the class action settlement resolving claims that Lenny & Larry’s The Complete Cookie’s nutritional value is misrepresented.

The U.S. government intervened, however, over concerns that non-Class Members, who would potentially receive free cookies, were getting more benefit under the deal than actual Class Members. Another issue was the sheer number of valid claims.

The original Lenny & Larry’s Complete Cookie class action settlement estimated approximately 10,000 total Class Members would opt for a cash payment of up to $50 with proof of purchase.

In reality 70,000 or 90,000 Class Members opted for cash payments, bringing the total award for each claim down to $25.

“Based on the claims administrator receiving over nine times the expected number of claims, the Parties shifted the resources that would have been allocated to the secondary distribution to the awards that will go directly to the claimants. This change more than doubles the amount of cash available to claimants seeking a monetary payment from $350,000 to up to $889,867.17,” notes the memorandum.

The revised deal also benefits Class Members who made claims without proof of purchase. Under the revised Lenny & Larry’s Complete Cookie class action settlement, claims without proof of purchase will receive approximately $4 more than under the original deal.

The free cookies will increase under the amended Lenny & Larry’s Complete Cookie class action settlement as well. Class Members without proof of purchase can receive a box of 12 cookies worth $21.95, as opposed to cookies with a retail value of $15 under the old agreement.

Class Members with proof of purchase can now receive cookies worth up to $35, in addition to shipping and handling. Under the original settlement, Class Members could receive up to $30 in cookies.

The vegan cookie company still asserts that it did not mislabel its products as alleged by the class action lawsuit. Indeed, the plaintiffs in the class action lawsuit claimed that Lenny & Larry’s misrepresented the fat, sugar, protein, and carbohydrate, as well as the calories of its product on the nutritional labeling.

The plaintiffs in the Lenny & Larry’s The Complete Cookie class action alleged that independent testing revealed the protein content of the products was much lower than advertised. They accused Lenny & Larry’s of intentionally lying to consumers about the nutritional content of their product to boost sales.
