A number of California companies, such as Casino Royale, may be violating state laws that prohibit the recording of calls to or from customers without those customers’ permission.

California Call Recording Laws

If you have been subjected to unlawful call recording by Casino Royale or another business while in California without first giving your permission, your right to privacy has been violated, and you may qualify to join a class action lawsuit investigation.

State laws in California regarding call recording are stricter than those at the federal level. According to California state laws, recording calls to or from customers without their permission is illegal.

These recording laws are part of the California Invasion of Privacy Act, which prevents companies from recording a call without the consent of all parties on the call.

Call Recording Practices

Call recording is a fairly common practice in California and elsewhere. Businesses often record calls to or from their customers to evaluate their own services and the performances of their employees.

While on a phone call with a business, you may be warned that the call will be recorded for “quality assurance.” In many cases, this warning is from an audio recording that doesn’t expect a response. A live speaker may or may not directly ask for a yes or no response, but this is not important.

Simply staying on the line rather than hanging up once a call recording warning has been given indicates consent. Likewise, if you do not want your call to be recorded after hearing a warning, just hang up.

If you do not hear this warning or something similar and believe the call was recorded, the company may have violated California call recording regulations.

An unlawful call recording by Casino Royale or another company violating the California Invasion of Privacy Act may be penalized up to $5,000 per individual violation. The settlement payout from a call recording lawsuit may be substantially more if multiple calls are at issue.

In some cases, these laws have led to a number of companies being forced to pay settlements in the multi-million dollar range.

Customers who experience unlawful call recording by Casino Royale, TGI Friday’s, Baja Fresh and other businesses while they were in California may be able to pursue litigation.

If you have experienced unlawful call recording by Casino Royale or another business while in the state of California, you may be able to seek compensation by participating in a California call recording class action lawsuit.
