A proposed $11.9 million settlement has been reached between computer company ASUS and its customers who allege that their laptops’ battery life was less than stellar, causing them to overheat. 

As part of the settlement, ASUS has agreed to give an extended warranty for all ASUS Rog Strix GL502VS laptops to cover “Qualifying Repairs.”

A Qualifying Repair includes the replacement of a motherboard and a new A/C adapter. The extended warranty has a value of $6.7 million.

In addition, the proposed settlement agreement will make up to $5.2 million accessible to Class Members. This includes a $210 Credit Certificate for all Class Members who had a power defect and/or overheating issues. These Class Members do not need to file a claim “unless they opt for a Cash Payment,” the settlement agreement states.

Also, the ASUS class action settlement agreement says, “Class Members can receive a $210 Credit Certificate or a $110 Cash Payment if they: (a) registered their Laptop with ASUS; (b) purchased their Laptop from ASUS’s website; or (c) submit Proof of Purchase of the Laptop with their Claim Form. Class Members who cannot meet any of these proof requirements can obtain a $105 Credit Certificate or $55 Cash Payment as long as they provide the Laptop’s Serial Number with the Claim Form.”

Lead plaintiff Joseph Carlotti alleged in his class action lawsuit that two ASUS Rog Strix laptops’ batteries drain very quickly, even when they are plugged into an outlet.

In addition, the laptops “experienced reductions in computational performance when it was low on battery power or when the battery was removed, even when the Laptop was connected to an electrical outlet; and that there was accelerated degradation of the Laptop’s battery.”

The plaintiff also argues that the laptops “inadequately dissipated heat” during certain tasks and they became too hot to use.

The ASUS class action lawsuit was filed in May 2018 alleging that ASUS breached expressed and implied warranties and that they hid the two defects in question. 

In addition, the lawsuit claims violations of the Magnuson-Moss Warranty Act, California Consumer Legal Remedies Act, false advertising under Business and Professions Code, and unfair business practices under California Business and Professions Code.

The ASUS class action settlement agreement states that 24,800 laptops were sold during the Class period.

Carlotti is seeking an incentive award of $5,000 and plaintiffs counsel is asking for $787,500 in attorneys’ fees.

    I have an Asus scar laptop that has been fixed 5 times threw best buy and is still gets hot where do I go from here no one will help me and I think it has this problem

    Does anyone know how to actually claim their share in the settlement if they have the effected laptop? I see everyone saying add me but I can’t imagine that’s actually how to do it.
    I also have an Asus GL502VS so if this is the way then please add me too, but if not does anyone know how to claim the settlement?
