
Google Nest class action lawsuit overview:

A new class action lawsuit alleges Google failed to disclose that the core functionality of its first- and second-generation Nest Learning Thermostat could be reduced or eliminated at any time.
Plaintiff George Tsourdinis claims Google failed to disclose that it could remove core software functionality from its Nest Learning Thermostat at any time, which he argues deceived consumers into purchasing a product that could be rendered obsolete at Google’s discretion.
“Google never told consumers prior to purchase that the NLT’s core functionality could be reduced or eliminated for any reason, at any time, without compensation to purchasers,” the Google class action says.
Tsourdinis wants to represent a nationwide class and Illinois subclass of consumers who purchased a first- or second-generation Nest Learning Thermostat and still owned the device as of Oct. 25, 2025.
Google coerced consumers into buying newer version of Nest Learning Thermostat, class action says
Tsourdinis argues Google “bricked” the first- and second-generation Nest Learning Thermostat by removing their ability to receive software updates and function as remotely-controllable thermostats — before the devices had reached the end of their useful life.
“Google failed to mention at the point of sale the potential loss of features and functions, while at the same time prominently advertising that the NLTs were ‘smart,’ provided Wi-Fi connectivity, and the ability to operate them via a smartphone app,” the Google class action says.
Tsourdinis claims Google and Alphabet are guilty of breach of contract, including breach of contract of the implied covenant of good faith and fair dealing, and of violating the Illinois Consumer Fraud and Deceptive Practices Act, California’s Unfair Competition Law and Consumers Legal Remedies Act, and the Computer Fraud and Abuse Act.
The plaintiff demands a jury trial and requests declaratory and public injunctive relief and an award of monetary damages, statutory damages, and/or punitive damages for himself and all class members.
Google recently agreed to a $135 million settlement to resolve claims it used Android devices to transfer information to Google without user permission, consuming cellular data.
