T-Mobile, Sprint merger class action lawsuit overview:

  • Who: A group of Verizon and AT&T subscribers filed a class action lawsuit against T-Mobile, Deutsche Telekom AG and SoftBank Group Corp.
  • Why: Verizon and AT&T subscribers claim the April 2020 merger between T-Mobile and Sprint was anticompetitive and injured them financially.
  • Where: The class action lawsuit was filed in Illinois federal court.

The April 2020 merger between T-Mobile and Sprint was an anticompetitive acquisition and collectively cost U.S. small businesses and AT&T and Verizon subscribers billions of dollars, a new class action lawsuit alleges.

A group of AT&T and Verizon subscribers claim the merger “combined two fierce competitors into a single behemoth with no incentive to compete meaningfully” against the “equally large” Verizon and AT&T.

Subscribers claim it was always T-Mobile’s long-term plan to merge with another wireless carrier to create “the best path to extracting every possible cent from American consumers and small businesses.”

T-Mobile class action claims number of states attempted to prevent merger

Fourteen states and the District of Columbia filed a lawsuit against the companies in an attempt to prevent the merger after it was announced in April 2018, according to the T-Mobile class action.

At the time, the states argued the merger would reduce competition and result in at least $9 billion worth of harm to consumers each year.

After the lawsuit from the states failed to stop the merger, subscribers claim, T-Mobile and Sprint would merge to become “a single large competitor that is more than happy to observe a competitive détente in return for stable market shares and prices.”

Since the merger, subscribers argue competition has “declined precipitously” and that quality-adjusted prices have inflated since T-Mobile, AT&T and Verizon have “no reason to compete as vigorously for subscribers.”

Subscribers claim T-Mobile, Deutsche Telekom AG and SoftBank Group Corp violate the Clayton Act and Sherman Act

The subscribers want to represent a nationwide class of all persons or entities who paid for a Verizon or AT&T mobile wireless plan on or after April 1, 2020.

They demand a jury trial and request declaratory relief along with treble damages for themselves and all Class Members.

In related news, earlier this month, T-Mobile, Sprint and Verizon deployed vertical location technology to help 911 responders pinpoint the location of a call coming from a multistory building.

The plaintiffs are represented by the Law Offices Of Kenneth N. Flaxman PC, Lieff Cabraser Heimann & Bernstein LLP, Berger Montague and Hausfeld LLP.

The T-Mobile and Sprint merger class action lawsuit is Dale, et al. v. Deutsche Telekom AG, et al., Case No. 1:22-cv-03189, in the U.S. District Court for the Northern District of Illinois.

T mobile, is a total rip off and liars. I thought I would get a good deal if I went with the Magenta plan well let me say they ran my credit, took 1500.00 in cash, then, I ordered the phones on line, what a mistake, went back to store, was scolded for ordering phones online, because then the associate doesn’t get their commitment. Called back on phone to customer service, then she was rude to me, I supposedly did wrong by ordering. my phones on line, then customer service got rude with me and said she would cancel all of it and start over, I told her no she then said well if I can’t start a new contract for you, then I can’t help you and she hung up the phone, so I was crying for the way she talked to me, the store didn’t want to help me, I knew then I should have just closed it out, but no I thought I was going to get a great deal. I was so wrong. The customer service guy in the store, was trying to explain my bill to me, he said you have 1500.00 in credit, ok I gave him 1500.60, then I purchased the phone Galaxy S1, the best galaxy at the time, I then purchased a model below the best model actually 2 of those, it was buy 1 get 800.00 off 2nd 1, ok. Bought 1 like the second 1, was told my payments would reflect everything on bill, it sure didn’t, never showed the 1500. down payment, I should have only owed about 120.00 monthly, first bill, 280.00. Called customer service, they didn’t see anything about 1500. on bill ,told them I couldn’t no way pay that much. They did lower the bill to 204.00, but looking online at bill I’m still paying for 3 phones no matter how much I payed already. I decided to call customer service this last August to find out how much it would cost me to close my account, reached a lady who didn’t speak very good English, according to her, there is no way to find out until I canceled account. So there you go. And the worst on top everything else. Very bad service, even though I was told we would have no problems. I’m out alot of money. I am on Medicare with an income of 445 monthly. Shame on t-mobile for ripping off us older adults, I hope you get what’s coming to you. I may never see any of my money back but as soon as I can ,I will leave t-mobile. Thank for letting me rant

  3. Fawn Duggar says:

Before covid I signed up with sprint with their “free” phones and only a $10 monthly fee for one of the 5 lines set up. Ended up with a over $200 phone bill. After 18 months the phone bill increased and I called customer service several times. Regardless how many times I didn’t want to pay equipment fees and wanted to pay off the remainder fee for the “free”phones I thought I signed up for. I tried to take off the insurance fees since it costs a lot to get a phone fixed even with the insurance prices. Over 8 months I still was charged $19 a month for one of the phones. Customer service told me that if I end a call before they finish it would be as if I never made the call. one time customer service put me on hold after 1 hrs waiting for them, I used my kids phone and I got in touch with the guy who acted like I was completely new. He told me that it wouldn’t show up in my account for calling for hanging up. In June I spent several hours so I told them I was ending service with sprint and transferred the 3 actually used. In November 2021 I had called to remove the 4th and 5th line since I didn’t need them. Called in February 2022 to cancel the 4th and 5th line again.. in June when I told them I was ending service to transferred to spectrum. I had automated payments and I had to cancel my credit card. I received collection agency that I owed $625 for not paying for sprint service. Sprint told me that although I transferred 3 lines I was still responsible for the 4th and 5th line because I am supposed to call customer service that I was terminated service. The 4th and 5th line had not been used over a year.. even after sending the collection agency that I still had 2 more days of service on the September 8th before it was actually terminated for failure to pay for the service.. I ended up calling customer service more than I call friends and family. And no matter how many times I asked customer service, they say I have only a few notes and they transferred me to someone else. They also kept saying that I signed up for leasing equipment that some old cheap phone that is 3g, and could not work on their network..

  4. David Best says:

Need to file class action to sprint mobile aka t mobile as to unethical and in professional business by employing what you are told instead of in hard copy so as to speak. In excution of there agree which they do not do or do not comply with.As verbalized not disclosed .Have major issue with them as this moment.Wish lawyer would contact me in regards to this issue, am told by numerous others that same issue as I .They just like me were done the same way.And also have major beef with sprint over same issue , they lied during execution of contract.
