Nestlé Coffee Mate Class Action Lawsuit Overview: 

  • Who: Four consumers have lodged a class action lawsuit against Nestlé USA, Inc. 
  • Why: The plaintiffs allege the company intentionally mislabeled Nestlé Coffee Mate products with inflated serving amounts.
  • Where: The class action lawsuit was filed in New York federal court. 

Consumers say they tested and found that Nestlé Coffee Mate packages are filled with far less product than advertised — more than 40 percent less in one instance, according to a class action lawsuit filed in New York federal court Thursday.

Plaintiffs Richard Howze, Brenda Walton, Catherine Rothwell, and Jenny Carey claim Nestlé prominently advertised a higher number of servings than actually exist in its Coffee Mate products. Plaintiffs want to represent a nationwide Class of consumers who purchased Nestlé Coffee Mate. 

Consumers Test Nestlé Coffee Mate Servings Claims

The plaintiffs say they used a measuring spoon and scale to test the accuracy of Nestlé’s listed serving size of one teaspoon, according to the class action lawsuit. The serving size is listed within the ingredients label on the product’s packaging. 

The plaintiffs say they conducted tests on eight different Nestlé Coffee Mate products and found they all were underfilled by between nine and nearly 50 percent, according to the class action lawsuit.

“Defendant is systemically underfilling the Products to provide significantly fewer servings than represented. This renders the Products’ serving size representations false and misleading,” states the Nestlé class action lawsuit.

Nestlé consistently and intentionally overstates the advertised serving amount across its entire product line since it knows doing so will persuade customers to purchase, the class action lawsuit further alleges. 

The company could also not have possibly been unaware of the actual volume of its products since it is “the world’s largest food companies,” the Nestlé class action lawsuit alleges.

Nestlé’s alleged actions put it in violation of New York City Consumer Protection Laws, including Deceptive Acts or Practices and False Advertising, claims the class action lawsuit.

Plaintiffs are demanding a jury trial, requesting compensatory, statutory, and punitive damages, and asking for an order stopping the company from falsely advertising Nestlé Coffee Mate servings. Plaintiffs also ask Nestlé be compelled to come out with a corrective advertising campaign. 

Nestlé was served with another class action lawsuit regarding the advertised serving amounts on its Nestle Coffee Mate products just last month. 

The company was also recently in the news for recalling 46 flavors of ice cream sold under its Toblerone, Oreo, and Mars brands, after the company’s manufacturer discovered the presence of a cancer-causing organic compound in a stabilizing-additive it was using at a factory in Spain.
