Nestlé Recall Overview:

  • Who: Nestlé is recalling 46 flavors of ice cream sold under brands like Mars, Oreo, and Toblerone.
  • Why: The company’s ice cream manufacturer Froneri discovered cancer-causing ethylene oxide in the stabilizing additive at its Spanish plant.
  • Where: Spain.

Nestlé is giving consumers a new reason to scream about ice cream with its announcement that at least 46 flavors of its ice cream — sold in Spain under brands including Mars, Oreo, Toblerone and more — have been accidentally contaminated with a cancer-causing chemical.

On Monday, Spanish non-profit consumer organization FACUA-Consumidores en Acción said Nestlé had provided it with an extensive list of products subject to recall. The recall was issued after the confectionary giant’s ice cream manufacturer Froneri discovered ethylene oxide in the stabilizing additive in its Spain-based plant.

According to the National Cancer Institute, ethylene oxide can damage DNA and causes cancers including Lymphoma, leukemia, stomach and breast cancer. 

Nestlé is not currently facing legal action over the recall, but Top Class Actions follows recalls closely as they sometimes end in class action lawsuits

Affected brands in Spain include Nestlé, Mars, Milka, Toblerone, Nuii, Oreo, Princesa, La Lechera and Smarties, FACUA reports. Consumers can check a list of affected products here, but FACUA warns that the list may not be complete. 

Mars in Spain has also reported that certain M & M’s, Snickers and Twix ice creams are affected.

Nestlé had also created a website where consumers can enter the batch number of their ice cream to see if it is contaminated. The company says the amount of the carcinogenic chemical in the ice cream is only “trace” and shouldn’t be harmful.

“The possible health risk derives mainly from the direct handling of the substance or from a hypothetical continued consumption in large doses,” it says.

FACUA said it advises users who have one of the affected products in their homes to “refrain from consuming them” and return them to where they bought them for a full refund.

Froneri, owned by Nestlé and a private equity firm, is reportedly the largest producer of ice cream in Europe by volume, and the second-largest in the world. 

Swiss multinational food and drink manufacturer Nestlé is a household name that is known for producing many of the products we buy and consume.

The Nestlé class action lawsuit filings follow claims that their products feature misleading labels, their products contain the wrong ingredients, their chocolate comes from child labor, and more.
