Brewing Class Action Against Demoulas Market Basket Coffee

A new class action lawsuit against Demoulas Super Markets alleges the company is way off on how many cups of coffee consumers can brew from its cans of ground coffee beans. 

Lead Plaintiff David Cohen says the super market’s Market Basket House Blend lines of ground caffeinated and decaffeinated coffee beans promise to percolate at least 76 cups, but only serve half that. 

Buyers of the beans “were cheated out of the 51% of the servings they paid for,” Cohen says in the lawsuit, filed in Massachusetts District Court Tuesday. 

He cites third-party lab testing done on the Market Basket ground beans showed that researchers could only squeeze 39 cups at most from the product. 

Cohen claims this isn’t stopping Demoulas, who print labels on its Market Basket coffee with statements promising it can make 76-79 cups. 

Cohen says Demoulas can’t honestly nor legally do this under Massachusetts’ General Laws, which protects consumers against specifically untrue and misleading advertising and breach of express warranty.

The Market Basket coffee class action lawsuit says his complaint is similar to several others out there and food producers are aware of the implications. 

“These claims are not new and are well understood by private label manufacturers,” Cohen said in the class action lawsuit, pointing to a recent $20 million settlement last year in November. 

Food manufacturers representing brands like Great Value, Food Lion, Market Pantry, Signature Select and others agreed on the deal after plaintiffs alleged packaging on certain packs were deceptive. 

Cohen says Demoulas holds a dominant slice of the coffee market under the Market Basket label, according to the class action lawsuit. 

Demoulas operates over 80 grocery stores throughout New Hampshire, Massachusetts and Maine. Its headquarters are in Tewksbury, Massachusetts. 

In addition to violating Massachusetts General Laws, Cohen is accusing Demoulas of unjust enrichment. 

The class action lawsuit seeks qualified class members who’ve purchased Market Basket House Blend coffees promising to make 76 or 79 cups. 

He estimates there are tens of thousands of potential class members.
