A group of food manufacturers have agreed to pay up to $20 million to settle a ground coffee class action lawsuit alleging deceptive packaging misled consumers about the amount of coffee they could brew.

Class Members include consumers who purchased Great Value, Bonus Blend, Flavor Peak, Food Lion, Hannaford, Market Pantry, and Signature Select ground coffee between Jan. 1, 2016 and July 29, 2020. Only coffee packaged in cans, vacuum bricks and jars qualify; consumers who bought the coffee sold in bags are not eligible for the class action settlement.

According to the class action lawsuit, Great Value ground coffee, Market Pantry coffee, and other related brands were deceptively labeled. The labels indicated that consumers could brew a certain amount of coffee from each package, but plaintiffs said the cup numbers were inflated.

A group of coffee consumers lodged the class action lawsuit against defendants Massimo Zanetti Beverage USA, Mother Parker’s Tea & Coffee USA, Ltd. and Reily Foods Company in Missouri state court. The companies sell a variety of coffees, including Kauai Coffee, Hills Bros, Marley Coffee, Mother Parkers, Bonus Blend, and French Market.

The complaint alleged that certain brands produced by the defendant companies were mislabeled regarding the number of cups of coffee that could be brewed with the amount of product inside. The plaintiffs contended that there was no way for consumers to reasonable know how much coffee they could make after purchasing the product and they relied on the accuracy of the labels when making a purchasing decision.

The class action lawsuit accused the defendants of unjust enrichment, breach of warranty, and for violations of Missouri, California, and Florida consumer protection laws, and the Uniform Commercial Code.

On July 24, 2020, Massimo Zanetti Beverage USA, Mother Parker’s Tea & Coffee USA, Ltd. and Reily Foods Company agreed to pay millions to consumers to end the Market Pantry coffee class action lawsuit, though they refused to admit any wrongdoing. According to the settlement agreement, the plaintiffs’ attorneys found the terms of the agreement “fair, reasonable, adequate, and equitable.”

The class action settlement agreement was granted preliminary approval on July 29, 2020.

In addition to the $20 million in payouts to Class Members, the defendants have also agreed to change their labeling practices, including their products’ packaging, along with print, graphic, online, and television ads. The settlement agreement also includes a total of $30,000 in plaintiffs’ awards and $4.7 million in attorneys’ fees and costs.

Under the terms of the class action settlement, Class Members can claim $1 for each eligible Market Pantry coffee, Great Value ground coffee, or other product they purchased. Class Members with a receipt or other proof of purchase can claim up to $30. Those without proof can claim up to $5.

To make a claim in the Great Value ground coffee class action settlement, Class Members must file a claim form either online or download and print a form to be mailed. Online claim forms require a Class Member ID number. Class Member ID numbers are included on settlement notices or Class Members can register online for a number.

Class Members must provide the number of units, including bags, bricks, cans, or jars of coffee they purchased, as well as the names of the stores where they were purchased, along with proof of purchase if applicable.

The deadline to submit a claim in the Great Value ground coffee class action settlement is Nov. 18, 2020. Class Members have until Nov. 2, 2020 to opt out of or object to the settlement. The final hearing is scheduled for Nov. 16, 2020.

Who’s Eligible

Consumers who purchased Great Value, Bonus Blend, Flavor Peak, Food Lion, Hannaford, Market Pantry, and Signature Select ground coffee between Jan. 1, 2016 and July 29, 2020. Only coffee packaged in cans, vacuum bricks, and jars qualify; coffee sold in bags is not eligible for the class action settlement.

Potential Award

Up to $30.

  • Consumers can claim $1 per qualifying product purchased
  • Consumers with proof of purchase can claim up to $30
  • Consumers without proof of purchase can claim up to $5
Proof of Purchase

Not required. However, consumers with proof of purchase can claim up to $30.

A Class Member ID number is required to make an online claim. Class Members can request an ID number online.

      I and another person received checks today with 4/23/2020 printed on them instead of 4/23/2021. Theses checks may be invalid with this date.
