Maybelline makeup contains oil despite advertisements that the products are oil-free, according to a recent class action lawsuit.
According to plaintiff Norah Flaherty, Maybelline Fit Me Matte + Poreless foundation, Maybelline Fit Me Concealer and L’Oréal Paris Infallible Pro-Matte foundation products all contain oils.
Consumers might seek out oil-free makeup products to suit their skin’s needs. For consumers with dry skin, oil in products could help nourish their skin and help any makeup look healthy and skin-like. However, for people with oily or combination skin, avoiding oil in makeup products can be vital to ensuring their makeup stays in place throughout the day. Other consumers may choose to avoid makeup with oil to prevent clogged pores and breakouts.
To match their skin’s needs, consumers like Flaherty allegedly purchased L’Oreal and Maybelline makeup products that were marketed as oil-free. Maybelline Fit Me Matte + Poreless foundation, Maybelline Fit Me Concealer and L’Oréal Paris Infallible Pro-Matte foundation products reportedly fall into this category.
Despite these representations, the products allegedly contain oil ingredients.
Maybelline Fit Me Matte + Poreless foundation reportedly contains tocopherol and isododecane. Maybelline Fit Me Concealer similarly contains tocopherol and hydrogenated polysiobutene, according to Flaherty. L’Oréal Paris Infallible Pro-Matte foundation also allegedly contains tocopherol acetate.
Although these ingredients may not immediately stand out as oils, Flaherty contends the ingredients are revealed to be oils based on their chemical structures.
For example, tocopherol is commonly known as vitamin C and reportedly contains several “functional groups” that result in the chemical being a “polar oil.” The other ingredients listed in the Maybelline makeup class action lawsuit allegedly have similar properties — all qualifying them as oils.
Flaherty argues that she and other consumers would not have purchased the Maybelline makeup if they were aware the products contained oils.
As a result of Maybelline and L’Oréal’s deception, Flaherty and other customers were allegedly financially injured by overpaying for the products.
Even worse, Flaherty contends, they were “deprived of their protected interest to choose the type and quality of products they use on their bodies.”
Maybelline and parent company L’Oréal allegedly knew their products contained oil ingredients but nonetheless decided to market their makeup as oil-free.
Flaherty says Maybelline and L’Oréal chose to market their products as oil-free despite their knowledge because they did not think customers like Flaherty would be able to tell the difference between oil and non-oil ingredients.
“On information and belief, Defendants through their employees did know that the Products contained oils, but chose to include ‘oil-free’ labeling because they did not believe their customers were well educated enough to know the difference,” the Maybelline makeup class action lawsuit contends.
Flaherty seeks to represent a Class of consumers who purchased Maybelline Fit Me Matte + Poreless foundation, Maybelline Fit Me Concealer and L’Oréal Paris Infallible Pro-Matte foundation products within the last four years. She also seeks to represent a subclass of consumers from Illinois who purchased the products within the last 10 years.
On behalf of herself and the proposed Class Members, Flaherty seeks injunctive relief, monetary relief, court costs and attorneys’ fees.

Please add me I bought makeup for months ago been seeing a eye doctor ever since about 3 days after first applying this makeup my eyes took a turn for the worst I have to go on steroid eye drops I had no idea it was the makeup until I did a trial run of the makeup for each time I have put this makeup on I am still experiencing eye pain and migraine headaches I took it up on myself today to check out a lawsuit on this makeup after I spoke with my doctor to confirm to him that each time I have applied this makeup after I was off of the steroids each time it made my eyes hurt so I will not be wearing this makeup again but I will be keeping it in case it has to go and be looked at.

I purchased Maybelline fit me for a few yrs. ago, I end up throwing a couple of bottles and kept a few but normally I use Revlon 24 hr. wear, but wanted to try something new, and within a few days I noticed how oily my face had become and that I was breaking out all around my chin and nose area due to how oily my skin is now from using the Maybelline foundation. This explains why it’s happening. Very upset about how they could and are lying to their customers!
