A federal judge has granted final approval of a Volkswagen class action settlement over allegedly defective timing chains.

The Volkswagen class action lawsuit settlement will end the consolidated consumer claims against Audi and Volkswagen that the manufacturers knew about defects in their timing chain that could cause complete engine failure.

Class Members included in the Volkswagen class action lawsuit will be eligible to recover up to $2,000 in timing chain system repair costs and up to $6,500 in engine repairs if those consumers went to an independent repair business.

As part of the VW class action settlement, the manufacturers will extend timing chain warranties on impacted vehicles to cover those for 100,000 miles or 10 years.

Chief U.S. District Judge Jose L. Linares determined that the Volkswagen class action settlement offer was fair and reasonable and in the best interests of the defendants and those who filed the suit.

The original Volkswagen class action lawsuit was filed by a group of consumers who discovered problems with their timing chain system in their vehicles and had to have it replaced. The lawsuit argued that drivers of those vehicles were at risk for rear-end and unavoidable accidents.

The VW class action lawsuit also included claims that the general public was at risk of being hurt in a serious accident if a Volkswagen or Audi vehicle suffered the timing chain problem unexpectedly on the roads.

The consumers said in the Volkswagen class action lawsuit that the makers of the cars knew about or should have known about the risks and failed to warn drivers and the public about the dangers.

Following the proposed settlement in the Volkswagen class action lawsuit, a total of 43 objections were filed. Many of those concerns related to the 100,000 mile or 10-year warranty. Some of the drivers involved in the suit said that those should be extended.

The defendants argued against any further extensions to the warranty suggestions, noting that the settlement offer did not have to agree with every desire of the Class Members involved.

The judge agreed, stating that so long as the settlement was reasonable and fair that it could be allowed to proceed. The judge overruled the objections and said they were without merit in his order.

To close out that Volkswagen class action lawsuit, the judge certified a settlement Class of entities and persons who leased or purchased a 2008 through 2014 Audi and Volkswagen vehicle in Puerto Rico and the U.S.

Attorneys’ fees of $8.5 million were approved by the judge in addition to reimbursement of $150,000 in expenses and fees incurred by the legal team in filing and trying the case.

    2010 Touareg TDI with 118k, timing chain failed. $8k to replace on a destroyed engine and $12k to replace the engine.

    Why would VW not be responsible for all failures on this? This ruling of cutting it off at 100k is a bad as VW’s timing chain issue.

    I have a 2012 GTi under 100,000 miles. When i brought it back in 2019, I was never told anything about time chain tensioner. Is it too late for me to file?

    2015 vw tiguan. Manufactured in 2014. 56k miles. Timing has jumped 14 degrees. Chain. Tensioner. Cam bridge. All shot. Still owe 10k on it. Out of manufacture warranty. Dealership has 2 more sitting on their lot a 2015 and a 2014. This is NOT coincidental!

      my Husband and I own a European repair shop, We have a customer with the same issue.
      After having her car at the dealership with no real answer, she had her vehicle towed to us.
      We replaced water pump timing belt and tensioner, We had the hardest time getting the timing set correctly on her 2015. We advised her to take it back to the dealership because of the issues this vehicle had. They told her we installed the timing belt incorrectly, not the issue, We believe it’s a Manufacture defect. please keep us updated on your progress if you could please. Thank You

    My 2012 Tiguan with only 97,000 and just under 10 years old, had the timing chain tensioner fail along with mass destruction. I’m being charged 7,500, still sitting at the dealership, as I don’t have the money. They said, oh, you have another issue that is unrelated, but the rest is from the tensioner failure. VW says I’m just out of their extended warranty on the tensioner, missed it by less than two month, expired 10/30/21, because that is when my car was sold, I guess. Beyond angry at this point. The vehicle I babied and took in for every single thing the the dealership suggested is reduced to a hunk of steel worth nothing unless those major repairs are made. I am at a loss, there must be another class action suit, this is not even remotely fair for all of us left hung out to dry because we fell just short of their arbitrary bs warranty period. Not to mention the safety issues involved, trying to be thankful for that but sure as heck, not feeling thankful for the manufacturer I’ve been fiercely loyal to for over 20 years. I don’t cry alot but many tears have been shed over this, very very distressed and hurt. Yes, taking this one very personally although there are so many of us out there.

      I only have 45k on my 2012 car CC (vibrations kept me from using it). When under the 10 year warranty, dealer checked car and never mentioned this problem. A week later the misfires started – but there was a PANDEMIC so I wasn’t going anywhere, including the dealer. I stayed home. So guess what, when I start driving again, misfires are worse and different dealer says the timing chain is so stretched it’s about to blow the engine – and now I’m beyond the 10 year extended warranty. Here I had started thinking about a new VW or Audi but came across this news and now I’m livid.

    I have a 2014 Jetta with only 67k miles as of yesterday and the timing chain went and I may need a new motor! There has got to me another class action to protect other consumers.

      I bought a 2012 VW Eos in 2015 and never received any recall or class action suit info about this. If it’s dangerous, I believe there should be no time limit on VW covering repairs. Also the oil consumption issue should be another suit as it seems this problem might be a known one.

        My ‘12 Q5 drains oil every week and the tensioner needs to be replaced! There’s got to be a way Audi recalls these and fixes these known issues!!

    I just had my 2010 VW CC motor take a crap. Mechanics wont touch it and I’m waiting to see what BS Michael Volkswagen in Fresno will tell me. I took the car for a timing cover gasket and cam shaft adjuster seal to be replaced in July of this year. 5 month later and 2,000 miles later what a coincidence my motor blew. I barley use the car cause I have a different commuter. The car would sit for weeks in the drive way. I asked them about the timing chain law suite and for them to look at the timing chain tensioner and all they said was will look at it when that time comes around. Well that time came around. I have a 2010 VW CC with a seized motor parked in front of my house that worth nothing now. My car has 155,00 miles and I just learned about this class action law suite that I guess I don’t qualify for. Any suggestions besides having to dump 5,000 dollars on a car that is now worth by KBB 6,500 running.

      I have a 2013 VW turbo beetle and I’m currently going through this now.
      I’m so devastated, the dealer is charging me 3500 to repair.

        I have a 2012 VW Turbo Beetle that just died after having it in for service. Had no clue about this timing chain issue. Took it back to mechanic and they said the timing chain jumped and hit pistons and valves need to be replaced. Costs more to fix than what the car is worth. Mechanic stated “that engine has a horrible history of wearing out the timing chain and not being durable. We have seen many premature failures.” If that’s the case, then why haven’t these engines been replaced?????? Now a car that on Monday was worth $5000 because it had very low miles, is worth NOTHING! Never received any information on this lawsuit either.

    I have a Audi Q5 2014 with 128,000 miles, had timing chain and case, along with tensioner,spark plugs replaced ,carbon scrapped in Feb. 2020. Total repair cost in Feb.$4299.31. Fastforward to Sept.2020 after oil change go on vacation and car shutdown in the middle of traffic on Sept.30 and would not restart. Had car towed to dealer where i was quoted $16,639.75 for repair. I was charged $613.78 for my diagnosis, currently in process of having car towed to my hometown dealer over 700 miles away. Quoted $650-1300 for tow charge
