A federal judge has granted final approval of a Volkswagen class action settlement over allegedly defective timing chains.

The Volkswagen class action lawsuit settlement will end the consolidated consumer claims against Audi and Volkswagen that the manufacturers knew about defects in their timing chain that could cause complete engine failure.

Class Members included in the Volkswagen class action lawsuit will be eligible to recover up to $2,000 in timing chain system repair costs and up to $6,500 in engine repairs if those consumers went to an independent repair business.

As part of the VW class action settlement, the manufacturers will extend timing chain warranties on impacted vehicles to cover those for 100,000 miles or 10 years.

Chief U.S. District Judge Jose L. Linares determined that the Volkswagen class action settlement offer was fair and reasonable and in the best interests of the defendants and those who filed the suit.

The original Volkswagen class action lawsuit was filed by a group of consumers who discovered problems with their timing chain system in their vehicles and had to have it replaced. The lawsuit argued that drivers of those vehicles were at risk for rear-end and unavoidable accidents.

The VW class action lawsuit also included claims that the general public was at risk of being hurt in a serious accident if a Volkswagen or Audi vehicle suffered the timing chain problem unexpectedly on the roads.

The consumers said in the Volkswagen class action lawsuit that the makers of the cars knew about or should have known about the risks and failed to warn drivers and the public about the dangers.

Following the proposed settlement in the Volkswagen class action lawsuit, a total of 43 objections were filed. Many of those concerns related to the 100,000 mile or 10-year warranty. Some of the drivers involved in the suit said that those should be extended.

The defendants argued against any further extensions to the warranty suggestions, noting that the settlement offer did not have to agree with every desire of the Class Members involved.

The judge agreed, stating that so long as the settlement was reasonable and fair that it could be allowed to proceed. The judge overruled the objections and said they were without merit in his order.

To close out that Volkswagen class action lawsuit, the judge certified a settlement Class of entities and persons who leased or purchased a 2008 through 2014 Audi and Volkswagen vehicle in Puerto Rico and the U.S.

Attorneys’ fees of $8.5 million were approved by the judge in addition to reimbursement of $150,000 in expenses and fees incurred by the legal team in filing and trying the case.

    I brought a brand new 2011 VW Golf from the dealership, which was a lemon from the start. After only 6 weeks of driving my engine stopped on a freeway ( very scary) They got a tow truck & I wanted a new Golf but all they did was keep it for 8 weeks & replaced the engine ( they say) but it still never ran well. In Jan 2019 I was just able to get it to my VW dealership and they told me it would cost another $4,500 after spending $495 on a new battery, spark plugs & numerous services. It now sits on the street & can’t be driven & also has the faulty airbags too. A $36k car is worth nothing. I have sent numerous emails to VW Australia over the seven years but they never once took responsibility for the drama Ive had. Poor service!

    Good afternoon,

    So, the Timing Chain on my 2014 VW Jetta has failed within the last 3 weeks, I believe the mechanic told me the tensioner bolts sheared off. Which brought additional problems to the engine after approximately $1300 in repairs. Now I am being told I should consider changing out the engine, which will cost me another $1500 to $2000, if not more. How can we all get into this Class Action Lawsuit, or start another one? The car falls within the time frame they state, but they come out and say it’s too late, what a joke!! If anyone knows anything new, please give this info. Thank you.

    My Response to Volkswagen Timing Chain Claim and Victoria A the Claim Administrator:
    Hello Victoria A.
    It clear why the VIN # doesn’t show in your database because I did not own the car at the time of the Volkswagen Timing Chain Deadline of January 25, 2019. I purchased my car on May 25, 2019 4 months after the deadline. Five (5) months later my out-of-pocket-cost for repairs was $4,030.46. I didn’t know about the Timing Chain problem until searching the internet this month. There must be some kind of compensation since I didn’t own the car at time of the deadline and therefore it wouldn’t be in your database.

    I don’t feel this is a justifiable reason to deny me compensation of $4,030.46 in out-out-pocket repairs, simply for the reason given, I DIDN’T OWN THE CAR AT THE TIME OF THE DEADLINE.

    There are a number of others people who did have possession of their car before the Claim Filing Ended on Jan. 25, 2019. Can anyone tell me what can be done to file another claim so we can get compensated?

    June 2020. I had to replace my timing chain, tensioner, intake camshaft and VVT valve on my Beetle 2013, 2.0 TSI turbo, 65,000 miles. I called the 1-855-206-9873. They said i am out of luck. The dead line was back in august 2019. I am out $2,400 for repair!. What next?

      Us too ours just went two weeks ago we don’t think it’s fair cause we’re out of a car completely cause it ruined the motor too

    In 2/2016 My 2010 Volkswagen CC engine seized with 101k miles on it. VW Mechanic’s said “It’s $4200 you need a new engine because we don’t know what’s wrong with the engine and if you want us to find out what’s exactly wrong it’s $600 up front just to diagnose”. I have paperwork for everything (and the quote) but waited to see if insurance would cover the car for water in the engine from the snow. Insurance claims looked at it and said there was no water in the engine and the remaining $7000 I owed on the lean was my responsibility and I needed a new car too (obviously).
    I have a folder full of mechanic visits I needed to make with this 2010 VW CC, it was a hot looking car but what a lemon. Does anyone know if I can get my paperwork (and story) into this class action suit? Thank you!

      I own 2 Jetta’s both of them diesels. Part of the problem is like they say take it to an authorized dealer to do the work and maintenance care. Yeh right with my newer one every time I did it came back with something wrong. I have an older one a guy who works only on be and he’s kept it running with almost 300 thousand and still going. Imagine that!

      Has anyone received reimbursement? My claim was accepted but they have been extremely hard to get in contact with. The Claim Administrator’s phone line is disconnected.

        My claim was accepted and they confirmed my check payment in the amount of $2542.99. That was in February 2019. It’s now May 2020. Every time I follow up with them since then about why I haven’t received it in the 4-6 weeks they told me I’m repeatedly told “they don’t know why”&”The resource team has not gotten back to the administrators about my inquiries” & “We can’t answer that, it’s internal”. Something is off with this and it’s very hard to find any information about others involved in this claim. Is this happening to anyone else?

      The website you listed is much more transparent then the American one which is timingchainsettlement.com
      Our claim deadline in the US was expired a long time ago (with no reimbursement yet for successfully approved claims. Maybe the Epiq Canadian branch is not fraudulent like ours seems to be!

    My timing chain just went December 24th , 2019 . On my 2012 Volkswagen Gulf GTI with 127,000 Km on it .
    I had my car towed to my local dealer Where they did the repairs that were completed January 10th 2020.

    The bill is approx $3000.00 as I haven’t finalized it yet .
    Can I get my money back where the class action was approved .

      Devan,
      You’re supposed to be able to if you qualify. If your claim is accepted you are supposed to be reimbursed for what you’re eligible for after submitted proof. But seems like something suspicious is gong on and they are withholding the money owed. It’s extremely infuriating and unjust after this whole nightmare with VW. All the lies, paperwork, phone calls, research and most importantly TIME wasted. How can they get away with all this. I had a very bad experience with my Audi. This whole thing has been terrible for years now being strung along. Who else is being jerked around about the reimbursement?

    How do I find out if I’m getting a reimbursement ? I sent all my proof/ receipts months ago and never heard anything back.
    Due to failure of the timing chain I needed to replace my engine which now has 30,000 miles on it. Does this mean that Audi has to fix the new engine as well ? Please help.

      Read the above comments. Stay on this, you are not the only one this is happening to. We need to find all the people going through the same situation and figure out what’s going on! Sick of people getting screwed over by big corporations.

        Same issue here. 2011 Tiguan w faulty tensioner chain causing catastrophic motor failure. 95,000 miles and just past the extended warranty. It has also had vacuum leak/rear mail seal or something issues that it shouldn’t have had. They fixed it once while under warranty then six months later said it needed it again to the tune of about $3000. They realized their error and re-repaired that, but now say they need $7100 for this timing chain/motor replacement. Where can I file or who do I contact to see if I am eligible at this point?
