Toyota roof rails class action lawsuit overview: 

  • Who: Todd and Judith Fishkind filed a class action lawsuit against Toyota Motor Sales U.S.A Inc. 
  • Why: The Fishkind’s claim Toyota manufactured and sold model year 2019-2021 Toyota RAV4 vehicles that were equipped with defective roof rails.

Toyota manufactured and sold model year 2019-2021 Toyota RAV4 vehicles equipped with defective roof rails that can ultimately render them inoperable, a new class action lawsuit alleges. 

Plaintiffs Todd and Judith Fishkind claim the alleged roof rail defect allows water to leak into the vehicle, including its dashboard area, causing electrical components to “malfunction without warning.” 

“Numerous owners of Class Vehicles have reported to the National Highway Traffic Safety Administration that this water leak has caused an electrical malfunction in their vehicle, rendering it inoperable,” the Toyota class action states. 

The Fishkind’s argue Toyota knew about the alleged defect as early as 2019, but chose to wait until September 2021 to remedy the issue and has since chosen to hide the design change from the public. 

“Unfortunately, and despite its purported commitment to customer satisfaction and safety, Toyota concealed this design change,” the Toyota class action states. 

Toyota accused of unjust enrichment, fraudulent concealment, law violations

The Fishkind’s want to represent a nationwide class and North Carolina subclass of all persons who have purchased and/or leased a model year 2019-2021 Toyota RAV4 vehicle. 

Toyota is accused of unjust enrichment, fraudulent concealment, and breach of implied warranty of merchantability, and of violating the North Carolina Unfair and Deceptive Trade Practices Act and the Magnuson-Moss Warranty Act

Plaintiff is demanding a jury trial and requesting class certification along with an award of actual, compensatory, general, special, incidental, statutory, punitive, and consequential damages for themselves and all class members. 

In December, a federal judge in New York granted final approval to a class action settlement agreed to by Toyota to resolve claims the automaker manufactured and sold vehicles with a fuel pump defect it allegedly failed to disclose or cover by warranty.

    I purchased a 2019 RAV4 adventure and had numerous problems with that like my heated seats randomly going on then I had to replace the all wheel drive system also had to replace the transfer case . This shouldn’t happen with a brand new vehicle. I contacted Toyota about my all-wheel-drive system malfunctioning and they refuse to pay for it. Then I finally realized my roof rails were leaking to the inside of my car and my car was completely labeled as having mold through the entire car, Toyota told me it was the roof rails and the reason why my heated seats malfunctioned is because the leak affected the electrical system and it would cost $14,000 to fix ! How is this acceptable with a brand new vehicle? They told me it was out of warranty so they couldn’t help me only with the roof racks cause it was their fault.!

    I just found out that this has what has caused my electrical issues with my Rav 4, I just received a bill for $19,000 to fix all this issues caused by this issue. However, I believe this is only for the US. Are you aware of any lawsuits or pending Class actions for Toyota Canada. Currently they are not doing helpful.

    I have a 2019 Toyota Rav4 XLE and am currently experiencing this exact roof rack leak issue, if anyone has any information or advice on what to do I would love to hear!

      I have a 2019 RAV4 XLE and today there appeared to be leaks on certain areas of my roof. I am the original owner of car and have never experienced leaks before.

    I had a 2019 Rav4, bought it used that had extensive damage from roof rack leakage. Dealership would not fix it until I contacted Corporate. It was repaired but my concerns were about unseen or unreported damage that were not addressed. My screen had begun to fog up. I then decided to trade the 2019 in on a 2022 new Rav4. This vehicle had 6 miles on it in August of 2022. I now have 7000 miles on it and at this moment it is back at the dealership with massive leaks EXACTLY as my previous Rav. They claim to have redesigned the seals on the 2022 but apparently that didn’t work!! I would love to know who else is having these issues. So stressful!!!

      We were impacted on out 2020 RAV4. Repaired by Toyota but still have occasional issue with clicking sound on high wind condition.
