Did your Volkswagen have engine stalling problems?

A lawsuit has been filed against Volkswagen Group of America Inc. regarding alleged defects in a range of vehicle models.

According to the class action lawsuit, Volkswagen vehicles have experienced engine stalling defects when decelerating, stopping, or making u-turns. If you own a Volkswagen vehicle that has an engine stalling defect, you may be eligible to join a class action lawsuit against the company.

Engine Stalling in Volkswagen Vehicles

According to Aceable, engine stalling can be caused by a variety of engine issues and happens when a car engine dies unexpectedly. While this defect can be caused by things like dirty filters and low fuel pressure, the suit against Volkswagen cites a specific defect in the company’s variable valve timing system.

The variable valve timing system is meant to keep all of the engine components moving in harmony, according to the suit, but plaintiffs allege that this system fails to function properly resulting in an inability for the engine to complete a combustion cycle. This can lead to a sudden and unexpected stall. Engine stalling can be dangerous and necessarily means the vehicle driver is not in control.

Volkswagen Engine Stalling Suit

A class action lawsuit was filed against Volkswagen regarding the engine stalling defect on May 28 of this year. The suit was filed by plaintiffs Marilyn Dickinson and Kate Conroy who both claim to have experienced stalling and paid for repairs out-of-pocket.

According to Law360, Dickinson alleges that her 2019 Volkswagen Jetta stalled 25 times within a short time of her purchasing it. When she took the vehicle to the dealership for repairs, she claims, her warranty coverage request was denied.

Allegedly, the dealership claimed that she had caused the issue by driving with the emergency brake engaged, implying that Dickinson didn’t know how to properly drive a manual despite the fact that she had been driving manual vehicles for 40 years at the time. Dickinson paid for nearly $2,000 in repairs but continued to experience engine stalling, according to the suit.

Did your Volkswagen have engine stalling problems?Conroy claims that her 2019 Volkswagen Tiguan stalled when she attempted to make U-turns. When she brought her vehicle to the dealership for repairs, she says she was told her Tiguan was functioning properly. She was offered a $5,000 credit towards leasing a new vehicle by Volkswagen, but the dealership allegedly refused to honor the offer and instead charged Conroy an early termination fee of $3,200.

On top of this fee, Conroy says she lost the $2,490 deposit when she traded in the vehicle.

The suit argues that Volkswagen knew about these defects but failed to warn consumers about the potential danger, instead forcing vehicle owners to cover the cost of the company’s mistakes.

This Engine Stalling Class Action Lawsuit is Dickinson et al. v. Volkswagen Group of America Inc. et al., case number 5:00-at-99999, filed in the United States District Court for the Northern District of New York.

Which Volkswagen Vehicles Are Included?

The suit lists a range of Volkswagen vehicles that may be affected by the alleged engine stalling defect. This list includes model years 2018 and 2019 of the following vehicles:

  • Volkswagen GTI
  • Volkswagen Golf
  • Volkswagen Jetta
  • Volkswagen Passat
  • Volkswagen Tiguan

The Volkswagen suit makes a class of plaintiffs that includes those who own the above vehicle types equipped with 2.0L TSI engines.

Should You File a Volkswagen Engine Stalling Lawsuit?

According to Car Complaints, customers who had experienced engine stalling requested that Volkswagen offer free repairs, but the car manufacturer allegedly continues to claim the vehicles are operating normally, denying any coverage under the vehicle’s warranty.

    My volkswagen vehicle didn’t stall persay, as I was driving on a freeway, it lost the ability to accelerate! Very dangerous on the freeway. I had to pay over a $1000 and wait for a part to be sent from Europe during the height of the pandemic and wait for weeks for the part to be sent. Without warranty, this had to be paid out of pocket. I’m on my 2nd recall driver side airbag has an issue. Just don’t have finances to change my vehicle. Is there anything I can do to get some of my hard earned money back??

    I’ve experienced my engine stall in my 2018 Passat 2.0 TSI model quite often. I have had it looked at a few times and I’m told there’s nothing wrong with it.
