ford truckA recent class action lawsuit claims that Ford Super Duty truck engines contain a chronic leaking defect which the dealer allegedly knew about.

Plaintiffs Jacques Powers and Janice McMillan recently filed a class action against Ford Motor Company on behalf of Big Island Climbers on the Mainland Inc., claiming that they experienced the defects after purchasing a used model year 2006 Ford F-350 truck.

In November 2005, the plaintiffs reportedly experienced steering problems while braking and driving, prompting them to bring their vehicle to an authorized service facility for repair.

The Ford truck class action states that their vehicle was repaired by correcting the alignment and replacing the front brakes. Plaintiffs believed that their vehicle would be fine at this point, but the truck reportedly continued to experience continued defects over the next several years.

According to the Ford truck class action lawsuit, Ford publicly promoted their fuel-efficient six-liter diesel engine as a desirable feature. However, the engine was allegedly a liability instead due to the chronic leaking reportedly caused by defects.

Powers and McMillan argue that Ford knew about the defect in their truck engines but chose not to warn consumers about the problem and instead provided quick fixes to affected vehicles without addressing the underlying issue.

“Despite its knowledge of the (six)-liter engine’s many flaws and quality concerns, Ford trained its dealers throughout the country to specifically tout the supposedly superior attributes of the engine, without ever mentioning its troubled history of design, manufacturing, and reliability defects,” the Ford truck engine class action argues.

The defects associated with the engines allegedly included injector malfunctions, cold start problems, idling problems, and engine stalls resulting from the issues. Powers and McMillan claim that these defects affected trucks from model years 2002 to 2006 equipped with six-liter diesel engines.

Ford allegedly obtained the affected engines through Navistar International Transportation Corp., the company which designed and supplied the allegedly defective engines. In 2007, Ford reportedly took action against Navistar and filed a lawsuit, seeking compensation for “exceptionally high repair rates and warranty costs due to quality problems attributable to Navistar.”

However, despite acknowledging the defects in their lawsuit against Navistar, Ford allegedly had aggressively marketed their engines while the Navistar models were used in their trucks.

Countless consumers reportedly fell for representations that trucks with the engines were fuel efficient and performed well, only to be met with an allegedly defective engine and countless problems.

“[Ford’s] conduct in employing these unfair and deceptive sales practices was malicious, willful, recklessly disregarded the harm to consumers, and was so reprehensible as to warrant the imposition of punitive damages,” the Ford class action states.

The Ford truck class action lawsuit seeks general damages, special damages, actual damages, restitution, incidental damages, consequential damages, civil penalty, punitive damages, court costs, and attorneys’ fees.

The plaintiffs, on behalf of Big Island Climbers on the Mainland Inc., are represented by Steve Mikhov of Knight Law Group LLC.

    Please add me. The truck is beautiful and I spent everything I had to buy it.It only had 124k on it and then 5 months later it started having every engine problem imaginable. I am a diesel engine and equipment mechanic and can’t even start to keep this thing running or afford to pay for any more parts. I work at construction sites all over pa for years with never a problem with Chevy and gmc duramaxes and then I bought a ford because I liked the look and I ended up losing a great paying job I had for 16 years because couldn’t get to work? I then got a job 40 miles away and lost that job due to point because my 6.0 powerstroke just shuts off wherever it feels like and won’t restart for 24 hours. Oooh yea and I moved during all this and had to rent,beg and borrow trucks to do that and some remodeling while I have 20k +worth of ford scrap metal sitting in my back yard I have to look at everyday. Buying this truck has ruined my life in so many ways for the last 2 years. Please help!!! And tell ford thanks for nothing. This was the first and last ford I will ever buy.

    I have a 2008 F350 6.4 L that threw a piston through the block at 128K and caught the engine compartment on fire. Is there a 6.4 class action? I know the 6.4’s continued with the 6.0 problems until they got someone else to build the 6.7. I really need help

    I bought a 2005 ford f250 diesel power stroke about a year ago and it is a piece of crap. I thought it was going to be my dream truck and it has been nothing but a night mare. What should I do. I took my whole savings to buy this truck.

    My 2006 F250 SuperDuty only has 122k and I just replaced the fuel control regulator (dealer keeps plenty on stock) last month and now I have a leaking egr cooler. If I could afford ( I can’t) I would replace this POS engine with a 12 valve Cummins.

    Add me I call my husbands truck the million dollar truck everytime you turn around there is sometime wrong with this truck.. It only has 150,000 and we are told it needs a new transmission we have a 2007 f350 6.0 superduty we have more into the truck than what we paid for it ugh!!!!!!
