2015-2017 Ford Mustang Trunk Defect Class Action Lawsuit Overview:
- Who: A pair of Mustang drivers filed a class action lawsuit against Ford Motor Company.
- Why: Plaintiffs claim Ford fails to disclose to consumers that its 2015-2017 Ford Mustangs come with a dangerous trunk lid defect.
- Where: The class action lawsuit is pending in Massachusetts federal court.
Defective trunk lid wiring harnesses on model year 2015-2017 Ford Mustang vehicles put drivers and members of the general public in danger, a new class action lawsuit alleges.
Lead plaintiffs Merhle Davis and Thomer Yetter claim Ford Motor Company manufactured 2015-17 Ford Mustang’s with a defective trunk lid wiring harness which interferes with the vehicles backup camera, trunk release, trunk light, and satellite radio reception.
Davis and Yetter want to represent a Massachussets Class of consumers who purchased or leased a 2015-2017 Ford Mustang vehicle.
2015-2017 Ford Mustang Trunk Defect Hidden From Consumers
The plaintiffs say they were never informed of any defect when they jointly purchased a 2017 Ford Mustang EcoBoost convertible from Carmax several years ago. The defect began to manifest itself in the early stages of 2020, causing their backup camera and Sirius XM radio to stop working, according to the class action lawsuit.
Davis and Yetter claim they took their 2017 Ford Mustang in for service at the dealership. The plaintiffs say they were told about a problem with the trunk’s wiring harness, but the dealership was unable to fix the issue despite attempting a repair and charging the plaintiffs a $200 deductible.
Plaintiffs claim Ford has routinely made the defect issue worse by either denying that a problem exists, or by communicating to its technicians a repair procedure that is “dangerous, inadequate, and does not repair the original defective wiring harness.”
2015- 2017 Ford Mustang owners and lessees who seek to fix the defect are often left with an expensive bill for a repair that does not work, the class action lawsuit alleges.
Davis and Yetter claim Ford knew all about the alleged defect before it began selling the vehicles, and, in December 2018, sent out a technical service bulletin to inform service technicians about the defect and its recommended repair procedure.
Despite this, Ford never issued a recall on the vehicles, successfully fixed the defect, or compensated or made drivers safe in any way, according to the class action lawsuit.
Davis and Yetter allege Ford is guilty of fraudulent omission and breaching implied warranty of merchantability, as well as in violation of Massachusetts General Laws Chapter 93A.
The plaintiffs are demanding a jury trial and requesting declaratory and injunctive relief, restitution, disgorgement, and compensatory, consequential, exemplary, and actual or statutory damages for themselves and all Class Members.
Ford told drivers earlier this month to stop driving their Ford F-150 SuperCab trucks if their seatbelts failed a self-inspection test, following a nationwide recall of the vehicle.
