Wyndham call recording settlement

Wyndham Hotels and Resorts has agreed to pay $7.3 million to resolve allegations that the company recorded the phone conversations of potential guests without their notice or consent.

Plaintiff Joyce Roberts filed the Wyndham class action lawsuit in 2012 over claims that California state laws were violated when resort phone calls were transferred to an Aegis-operated call center who allegedly didn’t inform consumers that the calls were being recorded.

The Wyndham call recording settlement covers the following hotels: Wyndham Rewards, Wyndham Hotels and Resorts, Wyndham Grand Hotels and Resorts, Wyndham Garden Hotels, Travelodge, Ramada, Knights Inn, Wingate, Days Inn, Super 8, Baymont, Hawthorn, Microtel or Tryp.

However, only phone calls routed to an Aegis call center are covered under the Wyndham class action settlement.

Those individuals who wish to object or be excluded from the settlement must do so no later than Aug. 18, 2016.

Who’s Eligible

Wyndham hotel call recording settlement Class Members include all California residents who called one of the toll-free numbers connected to Wyndham Hotels and Resorts between May 1, 2011 and Mar. 23, 2012, spoke with a representative and were recorded without notice that the call was being recorded.

Potential Award

$150 (minimum)

The $7.325 million class action settlement fund will be divided equally with all Class Members who submit a valid Claim Form. Each Class Member will receive a minimum of $150 but no more than $5,000 per qualified call.

    I sent my form back on Jan/20. I ask wen will the checks be mail out. They email me saying they receive my form and the administrator has to process it and she couldn’t give me an exact date but she said I’m claim is valid. Then they told me how much I was getting.

    I received an email from one of the Attorneys (Eric) yesterday stating the following: Teresa, the checks will be mailed in late February. The only people to have received checks already are class members who were credited with one call. Class members, like you, who have been credited with more than one call will have their checks mailed in late February. Hope this helps.

    This is what I got today. “We anticipate the initial distribution of payments to Class Members who have submitted timely and complete Substitute IRS Form W-9’s to occur on or about February 24th, 2017.”

    WOW!!!!! That’s more than a month away. What in the world have they been doing?!?!

      That’s completely unfair and I agree with whoever said that we are being unfairly penalized. the w-9’s were mailed on 1/11 and we were told to submit them within two weeks. at they very least these checks should be mailed on february 3rd. no wonder people always say that these lawyers and claims administrators are dirty and crooks. why do they need an additional four weeks from the w-9 due date to process these checks? they had no problem processing the other groups two checks within two weeks of each other. i want to complain but I don’t even think it would make a difference. I’m actually really pissed off right now.

        and what do they mean by “initial distribution”? That makes me believe that they are going to do what they did to the other group and not send the entire payment at once.

          They actually did the “first group” a favor by splitting the payments into two checks — one in 2016 and the second in 2017. The total payout for the group with only one call was about $925/each, and the rule is that any check payment over $600 requires a W-9. By splitting the payments between two years, the two payments of $462 each avoided mandatory tax-reporting.

            I know. They should have extended this same favor to us and sent us payments when the first group received them. The could have sent 599 payments and then asked us to return the w-9 if we wanted the rest.

            I’m curious if that is what they did or if it actually was not needed, I know at the casino there is the same rule but the casino only gets involved if the payment is 1200 or more.. wonder if there is the same issue here since the 1200 mark is the same… But I agree they did the first group a huge favor by getting them not only 1 but 2 checks in a fast and timely manner.

    I just received a W-9 a couple days ago that I emailed to the Attorney. I then received an email response back that they received it but no check as of today. I also mailed the W-9 just in case. I hope to be seeing a check any day now. I will believe it when I see it. :)

      The checks won’t be going out in january. that’s what the claims administrator said. you should check in with them to see if they’ve received your mailed copy.

        Iris did they give a time frame, Honestly Jan only has a week left so its not a long wait if they are going out early Feb. How do you check how many calls you have? Do you have their number?

          No time frame was given. I was told “not in january” last week. I agree, it’s unfair. I received my citibank check from rust two weeks after I mailed back in my w-9. We were told before the w-9 due date when the check were being mailed out. I’m not sure why they don’t have a set date for this one. It’s actually a little upsetting ready that they won’t be mailed until the end of February.

          I just realized that I didn’t answer your question. You can e-mail the claims administrator or attorney to find out how many calls you have. The attorney’s e-mail and w-9 are on the claim form. While you’re at it, please ask when the checks are being mailed and report back to us!

        Have you tried emailing the claims administrator? They have been telling people for weeks if they have a valid claim or not. It would save you the hastle of waiting

    Received the Form W-9 in the mail in CA today. The request for the form did not state the total anticipated payout, other than it is greater than $600. Does any one know the probable amount ?

      It depends on your personal amount of calls. I wouldn’t let them take the taxes out because they’ll take 35%. Your tax liability won’t be that high. Send the form back in and then you can send about 15% to the IRS on your own once you have the money. That’s what I did for Citibank and what I will do for this settlement. Or you can just worry about the taxes in 2018.

        Thats not what the letter states its say they will take out 35% if you done send it back in 14days

          The letter has the option of you returning it and also having them take out 35%. I personally wouldn’t let them do that because that’s not how much the average american’s tax liability is, unless you are getting a settlement of over $10,000. Even then, it’s not 35%. Rust just takes 35% because I believe the law requires them to do that when they don’t have a social security number for whoever they are paying

      People getting a w-9 form are people who are being paid for at least two calls. Could be more if you called more. You will be getting at least $1,848. Send the form back soon unless you want rust taking away $646 of that. I would also mail it back with tracking given that there’s a deadline and the form will have your social security number.

          I ended up receiving mine yesterday. I already faxed it back in. There was no date on the letter even though it says to return within 14 days on the date of the letter. Who knows when they were initially printed. I’ll be calling the attorney’s office on Wednesday to confirm that they received my fax.

    “Wyndham California Update posted on the website:
    Claimants who are scheduled to receive a single settlement check that is up to $599:
    Settlement checks mailed on December 30, 2016.

    Claimants who are scheduled to receive a total settlement payment of between $600-$1,199:
    Payments were split equally into two payments. The first payment was mailed on December 30, 2016 and the second payment will be mailed on or about January 13, 2017.

    Claimants who are scheduled to receive a settlement check that is more than $1,200:
    You will be receiving a Substitute IRS Form W-9 in the mail in January 2017. This is to satisfy IRS tax reporting obligations related to the payment you will receive.         Yes. They told me on January 3 that I had a valid claim and I never received a check when others did. On the 6th they told me that I had more than one call and would be receiving a tax form first sometime this month

      My husband got his and cashed it with no problem at U.S. Bank, which the funds are distributed from! That was the first, of two payments, $465+ each! It pays this time to respond to the little post card about this class action! Imagine our surprise when we saw the amount of the check! In the past, we got pennies for settlement. Congrats to those who did the same!
