On Tuesday, a California federal judge preliminarily approved a $7.3 million class action settlement over allegations Wyndham Hotels and Resorts LLC as well as Wyndham Hotel Group LLC unlawfully recorded phone calls without obtaining callers’ consent.
Plaintiff Joyce Roberts initially filed the call recording class action lawsuit against Wyndham in July 2012. She alleges that Wyndham violated California laws that prohibit the recording of telephone calls without providing notice to callers or getting their consent.
U.S. Magistrate Judge Paul S. Grewal certified the following Class for settlement purposes only: “All natural persons who were California residents and who, while physically located in California: placed a call to one of Defendants’ toll free telephone numbers at any time during the period from May 1, 2011 through March 23, 2012, inclusive; were routed to an Aegis-operated call center; spoke with a representative; and did not receive notice that their call was being recorded.”
The Wyndham call recording settlement covers certain calls made to toll-free numbers associated with the following hotels: Wyndham Rewards, Wyndham Hotels and Resorts, Wyndham Grand Hotels and Resorts, Wyndham Garden Hotels, Travelodge, Ramada, Knights Inn, Wingate, Days Inn, Super 8, Baymont, Hawthorn, Microtel or Tryp.
Only calls that were routed to a call center operated by Aegis are covered by this class action settlement. Consumers whose calls were routed to other call center operators were provided with notice that the calls may be recorded.
The defendants deny any liability or wrongdoing associated with the claims in the class action lawsuit, but agreed to a settlement to avoid the cost and uncertainty of ongoing litigation.
According to the settlement documents, the Settlement Administrator will establish a website with more information about the Wyndham call recording settlement. Notice will be sent directly to Class Members, posted in banner advertisements, and published in various publications that are distributed in California.
It is estimated that Class Members who submit timely and valid Claim Forms will receive a payment of at least $150 per qualified call, up to a maximum of $5,000 per call. The actual amount may be more or less than this estimate.
The final approval hearing for the call recording class action settlement has been scheduled for Oct. 18, 2016.
