A proposed settlement has been reached in the Wells Fargo inspection fee class action lawsuit, resolving claims that Wells Fargo & Co. and Wells Fargo Bank, N.A. improperly assessed property inspections when a mortgage borrower allegedly fell behind on payments by 45 days or more and charged borrowers for that inspection.

Furthermore, the plaintiffs of the Wells Fargo class action lawsuit claim subsequent inspections of the mortgage property were also allegedly ordered every 25 to 35 days for as long as the borrower remained delinquent in payments.

Finally, the Wells Fargo inspection fee class action lawsuit claims the bank concealed these fees from by consumers by labeling them as “Other Charges” on mortgage statements.

The plaintiffs bring several claims against Wells Fargo in this inspection fee class action lawsuit, including violations of California’s Unfair Competition Law and violations of the Racketeer Influenced and Corrupt Organizations by improperly and illegally assessing and charging property inspection fees.

Wells Fargo denies all liability and wrongdoing in this inspection fee class action lawsuit, but has agreed to settle the case in order to avoid the uncertainty of further litigation and increasing court costs.

Per the terms of the Wells Fargo inspection fee class action settlement, Wells Fargo will pay $27,750,000 to establish a settlement fee to compensate eligible Class Members for damages allegedly incurred by Wells Fargo’s actions.

UPDATE: The Wells Fargo Inspection Fee settlement is currently under appeal.  Claims will not be paid until all appeals are exhausted.  We appreciate your ongoing  patience. Who’s Eligible

You are a Class Member of the Wells Fargo inspection fee class action lawsuit if you had a mortgage serviced by Wells Fargo and you allegedly owe or paid a bank assessed inspection fee between Aug. 1, 2004, and Dec. 31, 2013.

Potential Award

Varies. Calculations of each Class Member’s portion of the settlement will depend on which settlement category they fall into and how many Class Members choose to participate in the settlement.

Proof of Purchase

Postcard Notices of this Wells Fargo class action settlement will be mailed to eligible Class Members on or before Oct. 17, 2015.

If you are part of the group of Class Members who are part of the “Post Sale” category, then you will need a Claim Number and Control Number in order to submit an online claim form. A complete claim form must be submitted online or mailed in postmarked on or before March 16, 2016.

UPDATE 2 on August 4, 2017: Appeals are resolved and the settlement became final and effective on June 12, 2017.  According to a motion filed with the court on August 1, 2017. the settlement administrator is still working through the claims review and deficiency process.  We appreciate your ongoing patience.     We got a post card stating that we did not submit enough information for our $5.00 settlement therefore we will not be receiving our $5.00 settlement….. I spent days putting this packet together with all the information they required in order to file. There is nothing else to send to them that could possibly help settle this case. So when they say they do not have enough information in order to settle, this is telling me do not waste any more time trying to claim my $5.00 settlement. The lawyers are making a fortune trying this case and the public will get either $5.00 or nothing at all for their labor. I through my card in the trash where it belongs…

    This is false. They are still allowing people to correct their deficiencies. Afterwards, the settlement administrator will have approval to distribute checks which will take at least 30 days minimum to process. As of October 3rd, people were still receiving their deficiency letters.

    Sorry everyone there has not been any checks for this class action, the checks that people are receiving are for the other class actions suits, there are plenty of them right now.. People receiving deficiency letters had incomplete information and have XXX number of days to return the requested information otherwise they will not receive settlement checks. Since the court released that information on September 14th, there is no way for people to respond to the letters and the lawyers verify its correct and then calculate payments… Sorry people but we are still going to be waiting a while!!!

    SETTLEMENT UPDATE: SEPTEMBER 14, 2017
    Though the Settlement has been finally approved, notification has been mailed to claimants who submitted incomplete Post-Sale claims of their opportunity to remedy curable deficiencies as required by the Stipulation and Agreement of Settlement. Once those deadlines have expired, the Court still must issue a Class Distribution Order before distribution to any Class Member can occur. Status updates, including if/when the Court issues a Class Distribution Order, will be posted to this website when available.

    Well it looks like other lawsuits settled and they will receive their checks within 60 days. So why is this case being put on the back burner? I’m with the other person who stated a category 5 will take us out before we see a dime!!!

      According to a motion filed on 8/1/17, the settlement administrator is still working through the claims deficiency and review process. Apparently there were several thousand deficient claims filed, which the settlement administrator is still working through. It is not known at this time how quickly claims will be paid. I’m sorry I don’t have better news for you. Please keep checking Top Class Actions for updates. We will let our viewers know as soon as we learn that checks are in the mail!

        I provided the claims admin copies of my mortgage statements/payment receipts for 5 years worth of their fraud. PAY ME NOW DAMN IT!!!
