Reservie-trans-reservatrol

Vitamin Shoppe Inc. has agreed to settle a class action lawsuit that alleges the company made false and misleading statements about the ingredients in its Reservie Trans-Resveratrol dietary supplement.

If you purchased Vitamin Shoppe’s Reservie Trans-Resveratrol at any time between Jan. 1, 2011 and June 6, 2016, you may be entitled to a cash payment from the Vitamin Shoppe class action settlement.

The Reservie Trans-Resveratrol class action lawsuit was filed in January 2015 by plaintiff Rebecca Scheuerman, who alleged that the supplement’s label falsely represented the amount of the Trans-Resveratrol French grape seed extract that is actually contained in the supplement.

Trans-Resveratrol is a naturally-occurring chemical commonly found in grape skins and in red wine. While it is commonly associated with grapes, it can also be found in knotweed, which the Reservie class action lawsuit alleges is a much cheaper source of trans-reservatrol than French grape seed extract.

According to the Vitamin Shoppe class action lawsuit, Reservie Trans-Resveratrol is actually made up of Japanese Knotweed, not French grape seed extract. Scheuerman alleges she and other purchasers of Reservie have overpaid for the product.

Vitamin Shoppe denies the allegations but has agreed to settle the Reservie Trans-Resveratrol class action lawsuit to avoid the burden and expense of ongoing litigation. The Reservie class action settlement was preliminarily approved on June 17, 2016.

Class Members who wish to object to or exclude themselves from the Reservie false advertising settlement must do so no later than Sept. 23, 2016.

Who’s Eligible

Class Members include consumers who purchased Vitamin Shoppe’s Reservie Trans-Resveratrol for personal consumption (and not for resale) in the United States between Jan. 1, 2011 and June 6, 2016.

Potential Award

  1. K. says:

The final order says checks are to be mailed 30 days after the Effective Date. That would have been approximately 4/17. SURPRISE they’re late. Lol… it also says checks will be $21 per person.

    1. MzUnderstood says:

Wow really how do you know ?

      1. Joe says:

Because it says in the final approval order :P… however to make one correction, it says that the settlement shall be funded within 5 business days after the effective date and then checks mailed 30 days after that.

        1. Joe says:

I was wrong, it does say 30 days after the effective date checks should be mailed. They are very late. Why does the claims administrator not get into legal trouble when they don’t comply with the court order?

  2. mari says:

    thank you Andy…for the info..

  3. mari says:

ok, what us the verdict on pay out Andy…

    1. Andy says:

Mari, for your future reference because I see you asking the same question on many different settlements. After the final hearing and the settlement is approved there is a 30 day period in which appeals can be filed. If no appeals are filed the settlement becomes effective.. In this case the settlement was approved on Feb. 16, given 30 days for appeals puts the effective date somewhere around March 17. Unless the settlement site (which there is a link to above) provides a timeline for distribution (which many don’t provide) you can assume the distribution will occur on an average of 90 days after the effective date. For this case that means roughly June 17.

  4. mari says:

OK, WHEN WE WILL START RECIEVING CHECKS, ANY UPDATES….

    1. Andy says:

I would tell you but I don’t talk to people who use caps lock

  9. mari says:

ok today is finally here, 1-26-17 let see what happens with final hearing, waited long enough….

  10. James says:

If you walk into a Vitamin Shop today, there are a handful of different brands of this same supplement being sold. Resveratrol isn’t the brand name. It’s the name of the actual drug. So possibly a lot of people who took it have no idea what brand they took and just know they took Resveratrol from Vitamin World.

So the email may be helpful in that sense. But I agree with others…. To word it as accusing each recipient as having committed fraud was highly incompetent on the side of the company. While I had purchased many products of the correct product and do know the answers, I am not going to be filling out this form. Instead I sent a nasty-gram to the settlement administrator about it, as well as cc’ing Vitamin World corporate as well.
