A $9 million class action settlement that resolves allegations of numerous tablet and smartphone makers installing wiretapping software on mobile devices is now open.
Smartphone and tablet consumers who bought a device manufactured by HTC, Huawei, LG, Motorola, Pantech Wireless, or Samsung with service on AT&T, Cricket, Sprint, or T-Mobile are eligible to join this class action settlement.
The $9 million smartphone privacy settlement was granted preliminarily approval last month by U.S. District Judge Edward M. Chen, who found the agreement to be fair and reasonable.
In addition to the cash pay-out, the defendants also agreed to fix the Carrier iQ software bug that allegedly had the potential to collect data from millions of U.S. smartphones and tablets.
The settlement comes after a long litigation battle that started in 2011, when plaintiffs claimed that some of the largest mobile device manufacturers in the U.S. installed software that was capable of gathering user names, passwords, text messages and Internet searches.
Despite numerous attempts by the defendants to dismiss the 70 class action lawsuits combined into a multidistrict litigation, the case moved forward.
In August 2015, both parties engaged in settlement negotiations but struggled to finalize a deal. However, by January 2016, a proposed class action settlement affecting nearly 79 million smartphone and tablet owners was reached.
The smartphone privacy class action defendants continue to deny all allegations but agreed to the terms of the settlement to avoid the cost of further litigation.
Class Members who want to be exclude from the settlement agreement must do so by June 4, 2016.
UPDATE: On June 23, 2016, consumers in this privacy class action lawsuit against several tablet and smartphone makers urged a California federal court to accept a settlement that would resolve allegations that the companies installed wiretapping software on mobile devices.

UPDATE: Distribution to eligible claimants is scheduled for September 20, 2018.
** Is it possible they meant October 20, 2018?
I meant 10/15/18
Looked at the website this morning and the UPDATE has been changed back to showing checks will be mailed to eligible claimants by September 20, 2018. Just 2 days ago the update said distribution was completed on Sept 27, 2018. This is so confusing…
Got mine in AR. Speechless.
Mel P, if you don’t mind, what’s the date on your check? It’s helpful to know if checks are still being mailed after the initial 9/27/18 checks went out. Appreciate the information.
I have also not received anything here in TN As far as I am concerned nothing is coming. I have given up
I really don’t care about how much I’m receiving .what really matters to me is all of everyone’s personal data in the hands of who knows who?the company’s know who..maybe ..and with these settlement agreement s they get away with stealing our personal information with just a few pay outs .what kind of justice and protection for the American people ?? None 0 nada we are all just money hungry consumers that just care about a few penny’s to give to the next company violating and exploiting us ..
I got my check over a week ago and deposited it and it still not cleared yet because some idiot reported them as fake checks so now every one is waiting for their checks to clear with extended holds …
I am also in So Cali and haven’t received my check. I emailed on a 2nd, got response following day to provide mailing address, for verification purposes, I guess. After that – silence. If you haven’t received check, email class administrator every day, they already got paid. There is information for attorneys, representing us on Settlement Documents. They have fiduciary duty to us, their clients.
I am also I’m in So Cali and haven’t received my check. I emailed on a 2 and, got response following day to provide mailing address for verification, I guess. After that- silence. I emailed again. I think, anyone who haven’t received their check should email claims administrator every day
Exact samebthing isb happening to me. After after responding to the address request they now say I listed no eligible phones. they’re either giving me the run-around or they’re too stupid to read because I listed the exact phones model number and dates purchased on the first email I sent them.
