A $9 million class action settlement that resolves allegations of numerous tablet and smartphone makers installing wiretapping software on mobile devices is now open.
Smartphone and tablet consumers who bought a device manufactured by HTC, Huawei, LG, Motorola, Pantech Wireless, or Samsung with service on AT&T, Cricket, Sprint, or T-Mobile are eligible to join this class action settlement.
The $9 million smartphone privacy settlement was granted preliminarily approval last month by U.S. District Judge Edward M. Chen, who found the agreement to be fair and reasonable.
In addition to the cash pay-out, the defendants also agreed to fix the Carrier iQ software bug that allegedly had the potential to collect data from millions of U.S. smartphones and tablets.
The settlement comes after a long litigation battle that started in 2011, when plaintiffs claimed that some of the largest mobile device manufacturers in the U.S. installed software that was capable of gathering user names, passwords, text messages and Internet searches.
Despite numerous attempts by the defendants to dismiss the 70 class action lawsuits combined into a multidistrict litigation, the case moved forward.
In August 2015, both parties engaged in settlement negotiations but struggled to finalize a deal. However, by January 2016, a proposed class action settlement affecting nearly 79 million smartphone and tablet owners was reached.
The smartphone privacy class action defendants continue to deny all allegations but agreed to the terms of the settlement to avoid the cost of further litigation.
Class Members who want to be exclude from the settlement agreement must do so by June 4, 2016.
UPDATE: On June 23, 2016, consumers in this privacy class action lawsuit against several tablet and smartphone makers urged a California federal court to accept a settlement that would resolve allegations that the companies installed wiretapping software on mobile devices.
Who’s Eligible
Carrier iQ settlement Class Members include all U.S. residents who purchased, owned, or were authorized users of certain phones and tablets manufactured by HTC, Huawei, LG, Motorola, Pantech Wireless, or Samsung with service on AT&T, Cricket, Sprint, or T-Mobile between Dec. 1, 2007 through Mar. 1, 2016.

The multiple smartphone and tablet manufacturers agreed to create a $9 million settlement fund. After court expenses have been paid, the remaining amount will be divided equally among all Class Members who file a valid and timely Claim Form.

I had a Samsung phone from cricket now I change my phone I only had it for 3months do I have a claim
I have had dozens of phones with AT&T. We have had 4 family lines since 2002 back when it was Cingular. How do we filefor different phones and/or lines?
I have the same question, how to file for more than 1 device/number?
Do the math – $9 million settlement divided by 79 million eligible devices = $0.11 per device. This one does not look likely to be worth the price of a stamp….

Eligible devices yes, but how many people will make the claim? Most of the people wont even know about this, and maybe half of those that do will make the claim…
Time will tell in the amount of the payment you receive.
But it was worth the price of a stamp and more ….$278.62 ?
I have been with AT&T since it was Cingular. I have had 4 lines. We all have right now, samsung, before that samsung, again samsung and even motarola. Att has a record of your phones.
Can you submit multiple claims, one for each phone that would be eligible for this?

I have had many phones as well.. I filled out one claim form per phone… if there is any questions the attorneys will call I’m sure … read the forms well and make sure you list the phone number you now use as your primary on the form.. it will ask what phone number that is included in the suit..

Exactly my thoughts and also have had my children on these plans with multiple phones as well.
I have had AT&T since 2000 and have had many phones, I would like to see if any of the phones I had are a part of this settlement but without having the phones anymore how are you supposed to check? I don’t keep the phones after I get an upgrade and don’t know many people that do.
I just called my carrier (AT&T) and asked them the make and model #s of all of the phones I have had on my plan since the start of our service. They had no problem giving me all of the information I needed, without any questions as to why I needed the information. Simple as that. I found out we have had 6 phones that are covered under this lawsuit. Now I just have to figure out how I can file a claim for all 6 of them. Good luck!
