Details:The Pella ProLine settlement will resolve a 2006 class action lawsuit, titled Saltzman, et al. v. Pella Corp., et al., that alleges the windows contain a design defect that allows water to seep behind the aluminum cladding and cause wood rot. Many of these windows are no longer under warranty, so the class action lawsuit is hoping to remedy the losses Pella window owners suffered as well as to extend the ProLine windows’ warranty.

Pella denies any wrongdoing and maintains wood rot can be caused by many different reasons other than a defective window design, but has agreed to a class action lawsuit settlement to resolve the litigation.

Class Members of the Pella ProLine window class action settlement include all persons in the United States who are current or former owners of structures containing Pella ProLine brand casement, awning and/or transom windows (including 250 and 450 Series) manufactured by Pella Corporation between 1991 and 2006.

Class Members can receive the following benefits under the Pella ProLine class action lawsuit settlement if they have suffered past water-related damage, current water-related damage, or suffer water-related damage in the future (up to 15 years after the Date of Sale) to the finishing on the window or to other property surrounding the window:

Cash Payment: Receive up to $750 per structure that contains/contained the eligible Pella ProLine products if you file a valid Claim Form no later than July 23, 2013.

Discount/Reimbursement: If you paid for repairs made prior to December 10, 2012, you can file a Claim Form to receive certain benefits for unreimbursed repairs or replacement of the window(s), including certain discounts and cash reimbursements. Details of what you can get are covered in Section 11 of the Pella ProLine Settlement Notice.

Arbitration:
If you feel you are owed more than the class action lawsuit settlement if offering, you can see payment for unreimbursed expenses by entering a court-approved arbitration process. The maximum award available in the arbitration is $6,000 per structure. Class Members will not have to prove a window defect but will have to prove that the “defect” caused the damages for which they are seeking compensation for. The deadline to apply for arbitration is July 23, 2013.

All Claim Forms and Arbitration Forms, together with supporting documentation or information, must be mailed and postmarked no later than July 23, 2013.

UPDATE: On June 2, 2014, the 7th U.S. Circuit Court of Appeals overturned the Pella window defect class action settlement after finding that its terms were “scandalous” and unfair to Class Members. 

UPDATE 2: On Feb. 8, 2018, after years in court, Pella Corporation agreed to pay close to $26 million to settle a class action lawsuit that alleged a line of its windows leaked and caused wood rot.

    Is any other law firm going to take this claim back to a new trial? I have close to $15,000 worth of damged windows and installation from these bad windows. It is not just Proline models. I have Designer, Proline and Architect models and ALL have the cladding delamination issue! All are from 1999 vintage and Pella even replaced sashes on windows where now the fixed pane is totally rotten and damged the house. They totally knew the fixed panes were bad but they did not want to full frame replace the windows so they just did the opening sashes. Now the entire window and wall is rotten. But hey the replaced sashes are totally useless in a rotted frame.

    June 14th 2014 I was informed to day that my pro line windows where in a class action law suit. I was never informed about this they want to charge my to install new ones, I also was told they had a 10 year warranty I bought my windows 1/23/2005 What and how do I get pella to honor their warranty?

    I got a letter seems like almost a year ago saying someone was going to come out and inspect my windows. It said someone would call, but I have not heard anything what so ever. Has anyone else received the same letter? And if so did you receive an inspection?

    Tia, you are not alone. All my Pella windows have mold growing on them and many are rotten. I understand that The court must hear and rule on all appeals and only then will compensation begin. Who knows how long this will take. May God judge this company!!

    Just had a Pella Tech come evaluate our windows as part of the lawsuit. So far have been told that much of the damage is due to the high humidity (25%) in our house – that’s a load of crap. He is guessing that only one window will be replaced. Does anyone else have terrible mold problems with these windows? It has ruined all of the finish too.

    My husband had pella windows and a sliding door put in, we throught pella were the best , the windows dont lock this is scary the slide door dont lock , we bought 7 windows and the door, this company is a scam !

    Built my house 1999. My builder installed 75 Pella Windows. Pella tells me warranty in only good for 10 years. I have replaced 4 windows prior to the ten years but Pella billed me for repairs. I was unaware of the class action law suit. Now replacing an additional 3 windows. Customer service gives me every excuse in the book. Poor install, Region of severe weather is the cause. I called Marvin Windows to replace my failing windows and the service rep informed me of the class action suit. Too late now for me Pella is the worst product on the world.

    We have Pella windows insalled throughout our home. (Built in 2000) At the time we had the home built we were told and thought Pella was one of the best windows on the market. Boy were we wrong in that assumption. When we found out about the lawsuit we filed the paper work. Since the filing we have not heard back on our claim. I am going to call the phone number to see if I can get any further information about our claim.

    Here it is now 10-10-13 and no indication of any movement toward a settlement! Can ANYbody shed some light on how the arbitration is proceeding? I sent in all forms and documentation as well as a detailed DVD Video of the repaoirs to my house, well before the deadline!
