Details:The Pella ProLine settlement will resolve a 2006 class action lawsuit, titled Saltzman, et al. v. Pella Corp., et al., that alleges the windows contain a design defect that allows water to seep behind the aluminum cladding and cause wood rot. Many of these windows are no longer under warranty, so the class action lawsuit is hoping to remedy the losses Pella window owners suffered as well as to extend the ProLine windows’ warranty.
Pella denies any wrongdoing and maintains wood rot can be caused by many different reasons other than a defective window design, but has agreed to a class action lawsuit settlement to resolve the litigation.
Class Members of the Pella ProLine window class action settlement include all persons in the United States who are current or former owners of structures containing Pella ProLine brand casement, awning and/or transom windows (including 250 and 450 Series) manufactured by Pella Corporation between 1991 and 2006.
Class Members can receive the following benefits under the Pella ProLine class action lawsuit settlement if they have suffered past water-related damage, current water-related damage, or suffer water-related damage in the future (up to 15 years after the Date of Sale) to the finishing on the window or to other property surrounding the window:
Cash Payment: Receive up to $750 per structure that contains/contained the eligible Pella ProLine products if you file a valid Claim Form no later than July 23, 2013.
Discount/Reimbursement: If you paid for repairs made prior to December 10, 2012, you can file a Claim Form to receive certain benefits for unreimbursed repairs or replacement of the window(s), including certain discounts and cash reimbursements. Details of what you can get are covered in Section 11 of the Pella ProLine Settlement Notice.
Arbitration: If you feel you are owed more than the class action lawsuit settlement if offering, you can see payment for unreimbursed expenses by entering a court-approved arbitration process. The maximum award available in the arbitration is $6,000 per structure. Class Members will not have to prove a window defect but will have to prove that the “defect” caused the damages for which they are seeking compensation for. The deadline to apply for arbitration is July 23, 2013.
All Claim Forms and Arbitration Forms, together with supporting documentation or information, must be mailed and postmarked no later than July 23, 2013.

UPDATE: On June 2, 2014, the 7th U.S. Circuit Court of Appeals overturned the Pella window defect class action settlement after finding that its terms were “scandalous” and unfair to Class Members.
UPDATE 2: On Feb. 8, 2018, after years in court, Pella Corporation agreed to pay close to $26 million to settle a class action lawsuit that alleged a line of its windows leaked and caused wood rot.

We are in the process of tearing out 14 Pella windows and one sliding glass door due to the rotten wood and mold. This is disgusting that our house is only 13 years old and this is what happens.No one notified us of a class action suit and now we are 1 1/2 months over the filing deadline for a claim. I really hate to pay the $125 for a rep to come out here and look at my windows,so far every rep I called has an attitude problem. I’m going to go thru the process the way they say you should and if that doesn’t work I will call the attorney general for Pa. and if that doesn’t work I will call a newscaster and see what happens .From reading peoples posts It looks like Pella is going to get away with this and that is just not right.Good luck to all who put in a claim
Just discovered 3 seperate Proline Pella casement windows that are rotted, and another that is fixed, all installed in 98, how in the world can you close the settlement, if you didnt know there was an issue till now??? They should be forced to keep it open, or start a new one, due to such a poorly designed window.
Bunch of crooks.
I had to replace all my rotten Pella windows but they were sliders and double hung. These are not covered in the current settlement. How can I find out if the lawsuit is continuing for the other type of windows? Do we need to start another lawsuit?? dw
I have Pella windows and doors throughout my home and ALL have had leaking and rotting problems, but our home was the model home in the development and I have no idea if they are part of the ProLine series or what series # they might be. How can I tell? and am I so late in finding out about the class action settlement that I’ll be ineligible? I only found out about the suit less than a week ago from a neighbor with the same problems.
I received notice my claim was potentially allowed & I called the administrator as per the letter & told them I was having a certified non-franchisor do the installation since their bid was $6,900 vs. franchisor’s $10,900 & was told OK they simply needed to know I was the person receiving the bid. I then called the franchisor & offered them the same opportunity and was told for them to give another bid would cost me $200. I then had the work done by the certified Pella installer and contacted the administrator who said I was not eligible for anything since I did not have the Pella franchisor do the work. I was sited paragraphs 77-84 in the settlement agreement. I find nothing in those paragraphs or any other place that precludes me from qualifying. Anyone have any ideas?

We have a total of 41 Pella Pro Line windows installed in our newly built home in 1992. Out of the 41 Pella Pro Line Windows 32 are casement. We had painted the windows closed them and never opened then due to our location. When we did the wind would sway the windows back and forth, causing an annoying noise, so we kept them closed but did noticed the wood discolored. When we finally did opened we found the wood had deteriorated to a dangerous state. We called the ins. company (Farmers) and as usual with Farmers, our claim was denied. Therefore we have to replace 13 casement sashes, at a cost of over $2900.00.Date 5/11. When some of the new windows were delivered we refused them due the very poor workmanship. Finally, all the windows were accepted and replaced. On 4-16-13 we noticed 2 more casement windows with deteriorating wood. Now, we will have to replace those 2. I would NOT recommend Pella anything to anyone. Maybe I can recoup the $750. allowed per structure in the class action suit…BUT we will see.

I have a bay window Pella Proline with 2 casements purchased in 2001. We have rot next to the casement window in the lower right corner that extends to the middle of the of the bay and up the side. Pella came to my home at a cost of $127.00 to look at the damage. He did not give me a reason that it happened. He stated only that it was rotted into the frame. A pella sales representative came today and he told me about the class action suit and I told him I already knew about it and that Greenfield, MA would not help me out with any warranty even though it was bought in late 2001. I told him the rot had started two years ago. No help from them just $127.00 to look at it. He told me I could put the fee on my credit card and that when the guy would look at it.He told me that I can hand him a check instead of credit. He ran my card and returned my check! SORRY! The window to replace is $5500.00 installed. It is a Pella Insulshield IGMAC P4-02 with casements Insulshield IGCC CBA IGMAC CIG 2-1-01 Wood inside painted, vinyl clad outside. Do we qualify for this suit? Thank you for your attention to this email.
We have all our receipts, canceled checks, etc. for 23 windows purchased b/t Dec 1999 & Jan 2000.
Our windows are Pella Pro-Line Double-hung with the following specs:

color: White size: 3765 vintage: 1199
Do we qualify for this class action suit for all our Pella windows? So far we have had to replace 6 and 2 more are recently rotted through as well.
