Ocwen Loan Servicing has set aside $100 million to voluntarily settle accusations that borrowers may have received misdated letters from the company that resulted in a referral for foreclosure.

New York Department of Financial Services Superintendent Benjamin Lawsky initiated allegations against Ocwen of backdating potentially hundreds of thousands of letters to borrowers which was likely to cause them “significant harm.”

According to Lawsky, these borrowers received a letter from Ocwen which denied a mortgage loan modification and informed the recipient that they had 30 days to file an appeal. However, the letters were allegedly dated more than 30 days prior to the mailing date so that by the time borrowers received the denial, the 30 days to file an appeal had already passed. 

In a statement given by Ocwen on the Misdated Letter Claim Program website, the company says it “sincerely regrets any difficulty these letters may have caused and is committed to preventing such errors in the future.”

Borrowers have until May 2, 2016 to file a Claim Form to receive payment from Ocwen. According to the loan company, the majority of claims are reviewed and processed within 180 days after submission.

Who’s Eligible

Eligible Ocwen borrowers included in this program are all individuals who received a misdated letter between Jan. 1, 2012 and Dec. 31, 2014 and were subsequently referred for foreclosure.

Potential Award

$300 – $3,000

Individuals who believe they were negatively affected by the Ocwen misdated letter and submit a Claim Form are expected to receive a payment between $300-$3,000 per loan.

To receive payment from this program, individuals must file a Claim Form. Those who are able to attach copies of Ocwen letter(s) showing the misdated document, will have their Claim Form processed quickly. Regardless, Claims will be considered even if documents are not provided.

      I have not received any settlement or denial letter pertaining to the Misdated Letter Claim as of yet, I did call today, and was told the same thing again, “Your claim is still under review”, the representative claims that they don’t know why claims are taking so long. I’m really under the impression, that if you haven’t received anything by now, you probably won’t receive anything, because initially, all check payments were to be made by late December 2016.

        Please don’t give up I’m asking all of us as victims let’s hire a lawyer to represent us as victims to file suite against Lee Steetlement and Ocwen to resolve this matter and treat the homeowners right. You got to ask yourself how can Lee Steetlement pay there people 5,000 off top and we the homeowners nothing we have to sit around and be told lie after lie we all are tired of the lies it’s time to take a stand and let Lee Steetlement and Ocwen we the people are not going to take this lieing down we are going to make a stand for what’s right

    Almost lost my home do to their irror. And I was told today, I’ll b receiving a check for! $300.00 the minimum. In the mail, mailed on Dec, 12 2016..Took a year and 2 months.

      I had to short-sell mine….to prevent foreclosure… I attempted a modification 2-3 times with no approval.
      Makes me wonder what compensation I’ll get!
      Lost a family home and family land!

        Hi same thing happen to me after being in my home for 10yrs, modification was approved making the 3 month payments on time, then boom ocwen lost documents so they say, rejected payment 4th month and no one knew what the hell they was doing and I as the consumer here in California had to short sale, I received a shitty payment today for $261.37 wtf and what a joke. The overall settlement for California was 225 million and I get a bs class action payment for this, I’m in disbelief and shocked. Screw ocwen and the attorneys we lined their pockets off the backs of consumers we lost everything
