ocwen misdated letters claim program

Ocwen Loan Servicing has set aside $100 million to voluntarily settle accusations that borrowers may have received misdated letters from the company that resulted in a referral for foreclosure.

New York Department of Financial Services Superintendent Benjamin Lawsky initiated allegations against Ocwen of backdating potentially hundreds of thousands of letters to borrowers which was likely to cause them “significant harm.”

According to Lawsky, these borrowers received a letter from Ocwen which denied a mortgage loan modification and informed the recipient that they had 30 days to file an appeal. However, the letters were allegedly dated more than 30 days prior to the mailing date so that by the time borrowers received the denial, the 30 days to file an appeal had already passed. 

In a statement given by Ocwen on the Misdated Letter Claim Program website, the company says it “sincerely regrets any difficulty these letters may have caused and is committed to preventing such errors in the future.”

Borrowers have until May 2, 2016 to file a Claim Form to receive payment from Ocwen. According to the loan company, the majority of claims are reviewed and processed within 180 days after submission.

Who’s Eligible

Eligible Ocwen borrowers included in this program are all individuals who received a misdated letter between Jan. 1, 2012 and Dec. 31, 2014 and were subsequently referred for foreclosure.

Potential Award

$300 – $3,000

Individuals who believe they were negatively affected by the Ocwen misdated letter and submit a Claim Form are expected to receive a payment between $300-$3,000 per loan.

To receive payment from this program, individuals must file a Claim Form. Those who are able to attach copies of Ocwen letter(s) showing the misdated document, will have their Claim Form processed quickly. Regardless, Claims will be considered even if documents are not provided.

    I just spoke to Administrator for Ocwen settlement and the young lady stated that checks aren’t scheduled to go out until late 2016 and no checks have gone out. Anyone who has received a check from Ocwen so far must be for something else and not the misdated letter settlement.

    05/31/2016 – called Ocwen Misdated letter toll free number this morning and spoke to a representative. She confirmed they received my completed form and informed me that they will be processing claims 180 days from May 2nd deadline and check will be going out by the end of 2016.

      Every time I call it’s a different story. I mailed my claim in October. I received a letter in December 15 saying they have all my information and I can expect a letter from them within 180 days of the December 15 letter. She told me by May 2.I called 6/7/2016 .Some guy said nothing will be sent out until the end of 2016. ANOTHER Misinform letter.

    Why do we have file out a claim form?! Ocwen knows who they have as customers and this is just another b.s. way of not following through with court orders. Still making customers jumping through hoops.

      Just an FYI. Most of the time it is the company (Ocwen) that is filing the class action lawsuit. IT clumps all the people together and they get away with paying a lot less and then they can not be sued by anyone else from this claim.

      I submitted my claim in october 2015 and I have not received anything yet. I emailed them several times and all I get are standard form emails that say the same thing everytime. It seems to me it will be a while even though it says on the form 180 days.

        The website now says that they expect the forms will be reviewed within 180 days of the May 2,2016 deadline with payments expected in late 2016. This, of course, is much different from their initial statement that said they would review the claims within 180 days of receiving them.
