Navient class action lawsuit

Navient Solutions Inc. (formerly known as Sallie Mae Inc.) has reportedly agreed to settle two class action lawsuits alleging it violated the Telephone Consumer Protection Act by continuing to contact phone numbers that were designated as a wrong number.

If you received text messages or phone calls from Navient on your cell phone between May 4, 2011 and Jan. 26, 2017 after Navient designated the cell phone number as a wrong number, you may be entitled to payment from the class action settlement.

Plaintiff Randy Johnson filed the initial class action lawsuit against Navient, claiming that Navient violated the Telephone Consumer Protection Act by using an automatic telephone dialing system to contact consumers’ cell phones, when the person subscribed to the phone number was different than the intended recipient.

Johnson asserts that, beginning in about September 2014, he began receiving calls from Navient on his cell phone. He says that each time he answered the call, he was greeted with an artificial or prerecorded voice. The calls were allegedly intended for a different recipient, and Johnson says that he informed Navient that he was not the intended recipient of the calls.

According to Johnson’s TCPA class action lawsuit, he has never been a customer of Navient and never consented to receive calls on his cell phone from Navient. He asserts that Navient violated the TCPA by contacting his cell phone using an automatic telephone dialing system without obtaining his prior express consent.

Shelly Toure and Tony Heard filed a similar TCPA class action lawsuit against Navient. This proposed settlement, if approved, will resolve both of these Navient class action lawsuits.

Navient has reportedly agreed to pay nearly $20 million to settle the TCPA class action lawsuit.

The Navient class action settlement was preliminarily approved on Jan. 26, 2017.

Who’s Eligible

Class Members of the Navient TCPA settlement include: “Each person and entity throughout the United States: (a) to whom Navient Solutions Inc. placed one or more telephone calls; (b) directed to a telephone number assigned to a cellular telephone service; (c) by using an automatic telephone dialing system; (d) after Navient Solutions Inc. designated the telephone number to which it placed the call(s) as a wrong number; (e) between May 4, 2011 and January 26, 2017.”

Potential Award

$200 – $350 (estimated).

Each Class Member who submits a timely and valid Claim Form will be entitled to a proportional share of the settlement fund. The actual amount each claimant will receive depends on the total number of approved claims. Class Counsel estimates that the cash award will be in the range of $200 to $350.

    I doubt the checks are fake.I have received settlement checks in the past that state: ‘This check may not be cashed at a check cashing agency or money service business.’

    These checks are fake. I notified the bank about this fraud scam. The guy who signed my check has his signature on many fake checks online. This guy must work at several different banks in several different states. The person responding to you on this website is a scammer. Once the checks are sent back to this fraudulent PO Box number they will have our account numbers to our bank accounts and they will really do great damage beware.
