navientTop Class Actions viewers report that they are starting to receive big settlement checks from the Navient TCPA class action settlement.

According to posts on the Top Class Actions Facebook page, Class Members who submitted valid claims for the Navient TCPA settlement began receiving checks worth as much as $510.27 on Sept. 22, 2017.

The TCPA, or Telephone Consumer Protection Act, was enacted by the federal government to protect consumers from unwanted, annoying phone calls and text messages from companies and solicitors.

Under the law, companies are prohibited from using automated dialers and prerecorded messages, sending unsolicited text messages, sending unwanted faxes, and calling numbers on the National Do Not Call Registry or any company’s “do-not-call” list.

Companies are also required to allow consumers to opt-out of messages. Violations of the TCPA carry steep fines between $500 and $1,500 per violation. Many large companies have faced accusations by consumers over TCPA violations.

The Navient TCPA class action settlement ended litigation over allegations that Navient made repeated unwanted calls to consumers’ cell phones using auto-dialers. Two class actions were filed against the company and the litigation was ultimately consolidated in Indiana federal court.

The plaintiffs alleged that on multiple occasions they received calls from Navient on their cell phones. They claimed that when they answered, they heard a recorded voice. The plaintiffs say that the calls were not for them and they had never been Navient customers or agreed to receive automatic calls from the company. According to the class actions, Class Members received robocalls from the company starting May 4, 2011 until Jan. 26, 2017.

Under the terms of the settlement, Navient agreed to pay $17.5 million. Each Class Member was expected to receive an estimated $200 to $350, but some TCA viewers are receiving much more.

The deadline to file a valid claim in the Navient class action settlement was May 26, 2017.

Class Members included individuals and entities in the United States: “(a) to whom Navient Solutions Inc. placed one or more telephone calls; (b) directed to a telephone number assigned to a cellular telephone service; (c) by using an automatic telephone dialing system; (d) after Navient Solutions Inc. designated the telephone number to which it placed the call(s) as a wrong number; (e) between May 4, 2011 and January 26, 2017.”

The settlement was approved by a federal judge in July of this year.
