A settlement has been reached in a class action lawsuit alleging My Pillow Inc. made false and misleading statements with regard to its MyPillow products, causing consumers to pay more for the products than they otherwise would have paid.

If you purchased one or more MyPillow products between Apr. 26, 2012 and Oct. 13, 2016, you may be entitled to a cash payment from this class action settlement.

The MyPillow class action lawsuit was filed in April 2016 by plaintiff Armin Amiri who claims he purchased the product in reliance on the statements made in advertisements and other promotional material for the MyPillow product.

According to NBC News, My Pillow makes unsubstantiated claims that its MyPillow products can treat or cure several sleep disorders such as sleep apnea, restless leg syndrome and insomnia. The company was recently ordered to pay a $1 million fine for its false advertising campaign.

The MyPillow class action lawsuit asserts the www.MyPillow.com website and product packaging makes the following misleading claims about the benefits of the MyPillow products:

  • “Guaranteed The Most Comfortable Pillow You’ll Ever Own!”
  • “I invented My Pillow to solve all of these sleep problems”
  • “You will go into REM sleep faster and remain there longer for more productive sleep”
  • “Adjusts to any sleep position”
  • “Helps relieve pressure points and gets your body to right temperature for you to get into the REM and DELTA sleep cycles”

My Pillow denies any wrongdoing but has agreed to settle the class action lawsuit to avoid the burden and expense of ongoing litigation. The MyPillow settlement was preliminarily approved on Oct. 13, 2016.

If you would like to opt out of or object to the MyPillow class action settlement, you must do so no later than Dec. 26, 2016.

Who’s Eligible

Class Members of the MyPillow settlement include anyone who, between Apr. 26, 2012 and Oct. 13, 2016, purchased one or more products bearing the My Pillow brand label.

Potential Award

Up to $10.

Class Members who submit a timely and valid Claim Form will be eligible to receive a $5 cash payment. Class Members who purchased three or more MyPillow products and who provide proof of purchase will be eligible to receive an additional payment of up to $5.

Proof of Purchase

To request a refund from the MyPillow settlement, Class Members must either return the MyPillow product, provide an original purchase receipt or sign the Claim Form under the penalty of perjury.

Class Members who purchased three or more MyPillow products must submit proof of purchase in order to receive an additional payment of up to $5.

    I have 3 of those. When take our car to go on vacation, we take the pillows with us. I was supper sceptical about the claims. But …after just using one for a week, I bought 2 more. I love my lumpy- bumpy MyPillow.
    I overheat at night and after trying many pillows over the years, the MyPillow is the only one that I am really happy with. Even during my night sweats, the pillow stay comfortable. Even when I wake drenched with sweat, the pillow somehow stays dry. ???. It get warm, but I flip it over and go back to sleep with no problem.
    And I do have back,- and neck issues, and so far this pillow is the best one I ever had.
    We are over 50, so when I say – I tried many pillows – I really mean it.

    We use king size, and I also have queen size (I started with).
    I really like the king size much better.

    False advertising? Half the crap that is advertised is false to some degree. These type of lawyers found an easy target. Class Action is just big money for the lawyers and ?’s for fools who fall for it. I brought My Pillow and didn’t like it and received my money back . No complaints. As for California I’m for their Independence. Just build the wall around it also because Mexico and Progressives will soon control it. But let us send all these type of lawyers there first.

    These pillows suck and it is a scam. The buy one get one free? No. you are paying the same price as for two pillows. The pillows are uncomfortable and it was not the “best nights sleep in the whole wide world”… just another scamming con job. This is why people don’t buy American anymore, false advertisement and poor quality.

No matter what you say or what you think, there is no merit here! Your mother would be ashamed of you for your unprofessional behavior. You give the law profession a bad name!

    It figures, a company based in the USA being sued by California lawyers acting like they give a hoot about the consumer. Tell me how this benefits society as a whole when a company has to pay out $1million instead of maybe improving worker benefits or something which really helps the average person.

      As far as I can tell the suit is a Miami Beach Florida court. I’m not sure if you realize that although it pisses me off too. Imagine if corporations didn’t need to worry about lawsuits like this one. Picture a loved one getting hurt by a company and you couldn’t do a thing about it. Believe me corporations do some horrendous things if they can get away with it!
