A settlement has been reached in a class action lawsuit alleging improper automated calls were made for debt collection purposes in connection with Macy’s and Bloomingdale’s credit card accounts. If you received an automated call to your cell phone from Department Stores National Bank and/or FDS Bank for debt collection purposes regarding a Macy’s and/or Bloomingdale’s credit card account between Sept. 3, 2009 and July 22, 2015, you may be entitled to a cash payment from the class action settlement.
Plaintiff Ameer A. Hashw filed the credit card class action settlement alleging that the defendants violated the Telephone Consumer Protection Act (TCPA) by placing calls to cell phones using and auto dialer and/or prerecorded message without first obtaining consent from the call recipient.
The defendants deny the allegations but have agreed to pay a total of $12.5 million to settle the TCPA class action lawsuit to avoid the expense, inconvenience and distraction of continued litigation.
Class Members who wish to exclude themselves must do so no later than Dec. 14, 2015.
UPDATE: On June 15, 2016, the Department Stores National Bank TCPA Class Action Settlement is currently under appeal. Claims will not be paid until all appeals are exhausted. UPDATE 3: On Nov. 7, 2016, Top Class Actions viewers who filed for the Macy’s, Bloomingdale’s credit card TCPA class action settlement started receiving checks in the mail worth as much as $34.59. Congratulations to everyone who got PAID!
UPDATE 4: On Jan. 16, 2018, Top Class Actions viewers started receiving a second round of settlement checks from the Macy’s Bloomingdale’s credit card TCPA class action settlement worth as much as $7.37.
Who’s Eligible
Class Members of the TCPA settlement include all persons nationwide whose cellular telephone number, at any time on or after Sept. 3, 2009 through July 22, 2015, Department Stores National Bank and/or FDS Bank called using an artificial or prerecorded voice and/or using any automatic telephone dialing system where the call was placed for debt collection purposes in connection with a Macy’s and/or Bloomingdale’s credit card account.
To qualify for benefits, the person must not have provided the cell phone number to defendants and/or the person must not have consented to receiving calls at that phone number.

Potential Award
Up to $750, depending on the number of valid claims submitted.
NOTE: If Class Members do not cash their checks, the amount will be redistributed and your total payment may be more than $750.

I like Macy’s cause they have that nice big red star on all the ads.
the appeal is from someone who wants the claim numbers audited so that only valid claimants will be paid. if the fraudsters are removed then the checks to valid claimants will be over $100.

Received a check for $34.59 in the mail yesterday!
I just called and was told the checks that were due to be distributed in July are now on hold due to an appeal that was just put in. So more waiting! Meanwhile, Macy’s has been calling me up to six times a day because I am behind on payments. It’s impossible to catch up with their high interest rate and late charges! I told the lady that I thought this lawsuit would stop the calls but she said she doesn’t know anything about that!
You should pay your bill. I received calls when my card was being paid on time. If you don’t pay your bills then they are allowed to call and request payment. This lawsuit doesn’t stop you from being responsible for paying your debts. If you can’t afford to pay interest rates, don’t use the card. If you can’t afford late payments, pay your bills on time. Don’t use this lawsuit as an excuse.
