Bloomingdale's credit card

A settlement has been reached in a class action lawsuit alleging improper automated calls were made for debt collection purposes in connection with Macy’s and Bloomingdale’s credit card accounts. If you received an automated call to your cell phone from Department Stores National Bank and/or FDS Bank for debt collection purposes regarding a Macy’s and/or Bloomingdale’s credit card account between Sept. 3, 2009 and July 22, 2015, you may be entitled to a cash payment from the class action settlement.

Plaintiff Ameer A. Hashw filed the credit card class action settlement alleging that the defendants violated the Telephone Consumer Protection Act (TCPA) by placing calls to cell phones using and auto dialer and/or prerecorded message without first obtaining consent from the call recipient.

The defendants deny the allegations but have agreed to pay a total of $12.5 million to settle the TCPA class action lawsuit to avoid the expense, inconvenience and distraction of continued litigation.

Class Members who wish to exclude themselves must do so no later than Dec. 14, 2015.

UPDATE: On June 15, 2016, the Department Stores National Bank TCPA Class Action Settlement is currently under appeal.  Claims will not be paid until all appeals are exhausted.  We appreciate your ongoing patience. UPDATE 3: On Nov. 7, 2016, Top Class Actions viewers who filed for the Macy’s, Bloomingdale’s credit card TCPA class action settlement started receiving checks in the mail worth as much as $34.59. Congratulations to everyone who got PAID!

UPDATE 4: On Jan. 16, 2018, Top Class Actions viewers started receiving a second round of settlement checks from the Macy’s Bloomingdale’s credit card TCPA class action settlement worth as much as $7.37.

Who’s Eligible

Class Members of the TCPA settlement include all persons nationwide whose cellular telephone number, at any time on or after Sept. 3, 2009 through July 22, 2015, Department Stores National Bank and/or FDS Bank called using an artificial or prerecorded voice and/or using any automatic telephone dialing system where the call was placed for debt collection purposes in connection with a Macy’s and/or Bloomingdale’s credit card account.

To qualify for benefits, the person must not have provided the cell phone number to defendants and/or the person must not have consented to receiving calls at that phone number.

Potential Award

Up to $750, depending on the number of valid claims submitted.

NOTE: If Class Members do not cash their checks, the amount will be redistributed and your total payment may be more than $750.

    I have been contacted numerous times by Macy’s on my cell phone in regards to debt collection in the past 2/3 years. They contacted me even though my bill was up to date and payments were made… Arghh

      The same with me, my payments were up to date and I was being called about a debt and late payments!

    I had a Macys card as well. I need to find out if they called my old cell phone number. The number I no longer use, what should I do.

    The auto callers called me, got me, I paid a bill, said they would not charge me on a credit report but they did anyway for less than 90 days and less than $150. Do not normally use Maceys but they kept badgering you to open a credit card and get 20% discount. That discount turned into a mark on my Credit Report. In light of Maceys devious business practices, can I get the bad mark removed?

    I am a Macys card holder. It is quite annoying that as at today 10/15/2015. Macys has been bothering me days and nights with pre recorded voice messages without sending me any bill. I am seriously tired of the way they have been ripping their customers off charging me late fees without sending me my bill.

      Yeah… I actually stumbled on this site trying to find out if anyone has started a class action lawsuit against them with regard to their late fees. I just got charged a late fee of $21.40 – the whole price of the pillow I had bought and returned five days before the payment was due. (I had accidentally bought one, and then pillows were on sale again and I was able to get 2 new ones for $19.24). Even if they refund it, I am worried about my credit report and score. I seriously wonder how much of their overall revenue is from its credit cards.
