Lumber Liquidators has agreed to pay $36 million to settle multidistrict litigation involving allegations that some of its Chinese-made laminate flooring contained excessive levels of formaldehyde and that its flooring was not as durable as the company promised.
If you purchased Chinese-made laminate flooring sold by Lumber Liquidators between Jan. 1, 2009 and May 31, 2015, you may be entitled to benefits from the laminate flooring class action settlement.
The proposed Lumber Liquidators settlement will resolve two lawsuits, one of which alleged the Chinese-manufactured laminate flooring contained excessive formaldehyde levels and the other alleging the flooring failed to meet the industry standards for durability and scratch-resistance.
The plaintiffs claim that Chinese-made laminate flooring sold by Lumber Liquidators contained a dangerously high level of formaldehyde that made it unsuitable for use in a residence. They also claim that the flooring failed to properly adhere to the surface to which it was applied, causing it to buckle.
Lumber Liquidators was hit with more than 100 lawsuits following a March 2015 broadcast of “60 Minutes” that revealed Chinese-made laminate flooring sold by Lumber Liquidators allegedly contained six to seven times the amount of formaldehyde allowed under U.S. law.
Formaldehyde is a carcinogen, and exposure to the substance can cause headaches, nausea, and/or irritation of the eyes, nose and throat.
Lumber Liquidators denies the allegations but agreed to settle the laminate flooring class action lawsuit to avoid the expense and uncertainty of litigation.
The Lumber Liquidators laminate flooring settlement received preliminary approval in June 2018.
Class Members who would like to opt out of or object to the Lumber Liquidators settlement must do so no later than Sept. 4, 2018.

UPDATE (12/18/18)
The District Court approved the Class Settlement and fees on October 9, 2018 and November 15, 2018, respectively. However, an appeal has been filed by two objectors. That appeal has been docketed at 18-2351 Fourth Circuit. Until that appeal is resolved, the settlement benefits may not be distributed to class members. We are sorry for the delay. Updates on that appeal will be posted here.
Problem is the attys representing the class action settled too soon. There wasn’t enough money to go around to all the applicants after atts get their big fee. We got screwed. A few people appealed because they were only going to get $50.00 instead of a percentage that was originally planned. I should be getting $400 to $500 but they changed it to $50 because they didn’t realize so many people filed claims. Now we have to wait for all appeals to be over before getting anything. We should sue the atts. since they didn’t do a thorough job before settling. LETS GET TOGETHER AND DO THIS!!!!
If you got one of the postcards about this action do you still need your receipt to collect if that a ever will happen? I think LL is just waiting for us to forget about it.
LL is appealing. This is why nothing has happened
Why appeals block payments to injured buyers of a defective product. Where are the activist who addresses these wrong doings.
A year later and still have not received or heard of anyone recieving anything. Maybe 60 minutes can do a story on that.
I haven’t heard anything from the settlement yet and I don’t think we are going to get anything very annoyed
I am waiting to hear from this also.Has anyone heard anything?
