LifeLock has agreed to pay $68 million to settle allegations that the identity theft protection company failed to keep its promise of continuous security.

Lead plaintiffs Napoleon Ebarle and Jeanne Stamm filed the LifeLock class action lawsuit over claims that the company violated Arizona’s Consumer Fraud Act by falsely advertising the following promises:

  • Comprehensive services in detecting fraud
  • Timely and continuous alerts of potential fraud 24-hours a day, every day of the year
  • Keep customers’ personal data (credit card, social security, and bank account numbers) secure
  • A “$1 Million Total Service Guarantee,” which provides insurance up to $1 million against identity theft

The LifeLock false advertising class action lawsuit filed by Ebarle and Stamm contains similar allegations from an enforcement action filed by the Federal Trade Commission (FTC) last summer.

According to the FTC, LifeLock falsely advertised that it provided fraud alerts to customers as soon as they became aware of a potential threat between January 2012 and December 2014. LifeLock agreed to pay $116 million to settle that false advertising class action lawsuit in October 2015.

LifeLock denies the allegations brought by Ebarle and Stamm but agreed to the terms of the false advertising class action settlement to avoid the cost of further litigation.

Who’s Eligible

The LifeLock settlement is open to all Class Members who had a LifeLock identity theft protection plan at any time between Sept. 1, 2010 and Jan. 20, 2016.

You are a subclass member if you enrolled in a LifeLock identity theft protection plan between Jan. 1, 2012 and Apr. 30, 2015.

Potential Award

$14 – $39

The amount each Class Member receives will depend on how many people file Claim Forms and the date they enrolled in a LifeLock identity theft protection plan.

Class Members who file a Claim will likely receive $20; subclass members are expected to receive between $34 and $39 if they make a claim and between $14 and $19 if they do not file a claim.

The parties estimate that there are 6.7 million eligible Class Members.

All LifeLock Class Members must submit a Claim Form by Apr. 29, 2016 to receive a cash payout. Subclass Members who do not exclude themselves will automatically get a cash payout and an extra payment if they submit a valid claim.

    I never received a dime from life lock nor anyone else.I was with the company about a year when they called me and said they were no longer covering me but had all my info in there system.Drivers license,debit card,account numbers,etc.No lawyer has contacted me.I researched it but nothing about a lawsuit was available.This was 2014 to 2015 so why was I left out of this I clearly qualify.Then I contacted the attorney on the case after it came out .He took all my info as well and I haven’t heard a thing to this date.WHAT’S GOING ON WITH THAT AND WHERE’S MY SETTLEMENT MONEY??

    I received a check for $19.48 in October of 2016.. At the time.. I was just mourning the deaths of my Mom and Aunt … an going thru a divorce and moved out of the home the check was mailed to. My then husband packed all my stuff.. and I just found the check in one of the boxes I got around to unpacking. It’s dated October 11, 2016… It’s past 120 days… Would I be able to get a new check? please email me Thanks so much

    I cashed the $19.48 check I received and it was returned. The reason was a stop payment on the check.

    My husband and I each just received checks in the amount of $134.04!! Talk about shocked!! I could not believe it. What a nice surprise to have this extra money after being a victim of Lifelock’s shady practices. Thank you to Ebarle!!

    I don’t have a clue as to why I received the $19.48 check? I have never personally done business with LifeLock and don’t want to cash a check I am not entitled to. Can someone explain how this might have happened.
