The Home Depot Inc. has agreed to settle a class action lawsuit with consumers whose email or payment card information was stolen as a result of a data breach.

If you used a credit or debit card at a self-checkout lane in a Home Depot store between Apr. 10, 2014 and Sept. 13, 2014 or received notice from Home Depot that your information was compromised as a result of the data breach, you may be entitled to benefits from the data breach class action settlement.

In September 2014, Home Depot announced that it had been affected by a data breach that compromised the credit and debit card information from customers who used a self-checkout counter at U.S. Home Depot stores. The criminals also allegedly obtained a separate file that contained email addresses of some Home Depot customers.

The retailer was subsequently hit with several Home Depot data breach class action lawsuits filed by customers who claimed Home Depot failed to adequately safeguard their payment card and personal information. The plaintiffs also alleged that Home Depot did not provide affected customers with timely notice of the data breach.

Home Depot denies the allegations but agreed to settle the data breach class action lawsuit to avoid the cost and uncertainty of trial.

Home Depot has agreed to establish a $13 million Settlement Fund to provide compensation to consumer with documented losses linked to the Home Depot data breach. Home Depot has also agreed to provide 18 months of free identity monitoring services to customers who used a credit or debit card at a self-checkout lane in a Home Depot store.

Class Members who want to opt out of or object to the Home Depot class action settlement must do so no later than July 18, 2016.

All second checks were mailed out last week according to what the class council told me on the phone.

    1. Michael says:

I wonder if they will send out checks for the people that’s didnt out the w9

  3. scott says:

I received a first payment for a documented claim, and submitted the requested W-9 in early October.
    I haven’t received a 2nd check, though.
Is anyone else still waiting on their 2nd check to arrive?

    1. Susie K says:

Yes still waiting for my second check, but I never turned in the W-9 since I was out of town and missed the deadline of Oct 4th

    2. Michael says:

      Waiting.

  4. Jenn says:

I received my check but it was only $1767 out of the $9250 that I submitted. My first check was under $50. I don’t know why my whole amount wasn’t paid and I wrote to the claims administrator but of course I don’t know if they will write back.

    1. Mike V says:

      Where taxes take out.

      1. Jenn says:

        No taxes deducted

  5. Austin says:

My check arrived today for $5974.50 however that does not make it $10,000 my last check was only $234.37. Why would I not get the full $10,000? It was a documented claim.

    1. Sam L says:

I saw a few others looks like they got around 25X their documents claims up to 10K

  6. John Ja says:

I am still waiting on my second check, but never filled out the W-9 Are there others still waiting for their second check and did not will out the W-9?

  7. Austin says:

I received a w-9 a few weeks ago and filled it out. I subsequently sent an email telling them I had moved and to update my address. A couple weeks later they replied with “Distribution to eligible and timely claims occurred in March 2017” which I did indeed receive a check in April however why would I get a w-9 if I’m not going to get a second check

PS: Maybe it will arrive tomorrow, I’m in OH has anyone received one in Ohio yet?

  8. Rona says:

Second payments are being capped as I thought which is great! Received a little over $8k. Dorothy you should have received a W9 form to send back in to the administrator if your claim was “documented”. Only documented claims are receiving a 2nd payment.

    1. Sam L says:

How much was your first check?

      1. Rona says:

Both checks amount to the full $10k

  9. DOROTHY BROOKS says:

do everyone received one if they receive the first one in April..

  10. Contessa says:

Mine is here! I capped out!

    1. Rona says:

Great news, and the wait continues here, stalking the mailman, lol, just kidding! Glad you got yours!

      1. Contessa says:

        Thanks! And good luck everyone!

    2. Mike V says:

Received $8718 today and 370 last April!!!

      1. Mike V says:

Did your 2 checks add up to exactly 10k

        1. Rona says:

          Exactly! Each cent.

        2. Rona says:

          Capped or not, great news!
