The Home Depot Inc. has agreed to settle a class action lawsuit with consumers whose email or payment card information was stolen as a result of a data breach.

If you used a credit or debit card at a self-checkout lane in a Home Depot store between Apr. 10, 2014 and Sept. 13, 2014 or received notice from Home Depot that your information was compromised as a result of the data breach, you may be entitled to benefits from the data breach class action settlement.

In September 2014, Home Depot announced that it had been affected by a data breach that compromised the credit and debit card information from customers who used a self-checkout counter at U.S. Home Depot stores. The criminals also allegedly obtained a separate file that contained email addresses of some Home Depot customers.

The retailer was subsequently hit with several Home Depot data breach class action lawsuits filed by customers who claimed Home Depot failed to adequately safeguard their payment card and personal information. The plaintiffs also alleged that Home Depot did not provide affected customers with timely notice of the data breach.

Home Depot denies the allegations but agreed to settle the data breach class action lawsuit to avoid the cost and uncertainty of trial.

Home Depot has agreed to establish a $13 million Settlement Fund to provide compensation to consumer with documented losses linked to the Home Depot data breach. Home Depot has also agreed to provide 18 months of free identity monitoring services to customers who used a credit or debit card at a self-checkout lane in a Home Depot store.

Class Members who want to opt out of or object to the Home Depot class action settlement must do so no later than July 18, 2016.

Who’s Eligible

You are a Class Member of the Home Depot data breach settlement if:

  • You used your credit or debit card at a self-checkout lane in a U.S. Home Depot store between Apr. 10, 2014 and Sept. 13, 2014 and your payment card information was compromised;
  • You received notification that your email address was compromised as a result of the Home Depot data breach; or
  • You received a settlement notice by email informing you that you are a Class Member of the Home Depot settlement.
Potential Award

Up to $10,000 as reimbursement for documented losses related to the Home Depot data breach.

Home Depot has agreed to reimburse affected consumers for their documented losses related to the data breach, such as out-of-pocket losses, unreimbursed charges, or time spent remedying issues related to the Home Depot data breach.

Home Depot will also offer 18 months of free Identity Guard Essentials identity monitoring services to Class Members who used a credit or debit card at a self-checkout terminal in a Home Depot store between Apr. 10, 2014 and Sept. 13, 2014, and whose payment card information was compromised.

NOTE: Class Members may make a claim for both reimbursement and monitoring services.

Proof of Purchase

N/A. Class Members must complete and submit a valid Claim Form. If making a claim for losses related to the Home Depot data breach, Class Members must submit documentation showing they suffered out-of-pocket losses, unreimbursed charges or spent time remedying issues related to the data breach.

      No, not saying that. Idk the exact number of people. The settlement fund was 13m and quite a bit is left over. I got the figures out of the documents. The document filed on 7/18 states they shall complete distribution of the settlement fund within 90 days of this order and the parties shall file a joint status report. So hopefully we here something in the next couple weeks.

    I got a letter to fill out a W9 for a second disbursement since it would be $600 or greater. I’m happy about this but what’s odd is that I thought my original claim was denied and I was only paid the minimum amount of $25 on my first check. Does anyone know any information about these 2nd checks? I tried to call but there is no one to talk to at the main number.

      Each claim that was paid for documented proof is supposed to receive the full $10k benefit, minus any amount you’ve already been paid. Per court documents. After each claim has been paid the full 10k, the remaining funds are to be donated to 3 charities cy pres. The Atlanta legal aid society, the Georgia Bar and the Identity Theft resource center Filed in the courts on 8/01/17 I received a W9 as well and read that in court documents.

          Order granting distribution of the remaining settlement funds. It’s in the court documents on Pacer. Just look it up using the case number on Pacer.

        Does not say were getting 10K, Distribution is prorated, but does not say how much each person will receive.

          That’s correct. The motion does not state how many claimants are receiving a 2nd distribution or what the amounts are. It does state that each claimant will not receive more than $10k, which was the cap for Documented Claims.

            Because I read that there is $5,600,00 left in the settlement fund. And after the the 10k cap distribution for documented claims are paid, there will still be a balance of $3,400,00 left which will be then donated cy pres to the 3 recipients. I read this on 3of8 and 3of9 in 7/18 fillings. Just curious to know.

    I submitted a claim but didn’t see a way to submit proof. I have email copies of my receipts during this time period showing I used the self-checkouts with my debit card. I also received an email notification from my credit union that I was being issued a new card/# because of the Home Depot data breach. By the time this lawsuit came into play, the debit card I used had long since been destroyed & replaced so I didn’t have the last 6 digits to provide them with. I only had the last 4 digits. So far only received the free monitoring. I contacted the admin at least 5 times now. The first email I sent they asked me for my claim #. I sent them the requested info & have heard NOTHING back. I’ve emailed for a status update at least 4-5 times now & can’t get any response. Is there any course of action people can take who are being screwed by the actual admins who are supposed to be handling our claims???? Seems like some of us not only got screwed by Home Depot but we are also getting screwed by the admins of the settlement case.
