Harbor-Freight-Tools

Parties have reached a settlement in a Harbor Freight Tools deceptive pricing class action lawsuit.

Customers who between April 8, 2011 and Dec. 15, 2016 purchased merchandise from Harbor Freight Tools that was advertised with a higher reference price, or “comp price,” next to the actual offering price may be eligible for a settlement payment.

Plaintiff Jeffrey Beck accused defendant Harbor Freight Tools USA Inc. of deceptively promoting its merchandise as being “on sale” or marked with allegedly fictional “comp at” prices used to create the illusion of a discount.

According to Beck, items marked with a “comp at” price were not actually offered for sale at that price for 28 of the preceding 90 days. Beck claimed that Harbor Freight Tools never sells this merchandise at the stated “comp at” prices.

Therefore the difference between the “comp at” price and the actual offering price was a fictional discount designed to deceive consumers, Beck claimed. He argued that this Harbor Freight Tools deceptive pricing violated consumer protection laws.

The settlement does not require Harbor Freight to admit any liability or legal fault, and the court has made no such determination. Harbor Freight maintains it has complied with all applicable laws.

Who’s Eligible

Class Members covered by the settlement include U.S. customers who between April 8, 2011 and Dec. 15, 2016 purchased any product from Harbor Freight Tools that was advertised with a higher reference price adjacent to a lower current offering price, but which was not sold by Harbor Freight Tools at the higher reference price for at least 28 of the last 90 days prior to purchase.

Potential Award

Varies.

Qualifying Class Members have three possible recovery options, depending on how they can document their qualifying purchases:

  • A refund of either 20 percent in cash or 30 percent on a Harbor Freight Tools gift card of the “you saved” amount shown on a Harbor Freight Tools purchase receipt
  • A refund of either 10 percent in cash or 12 percent on a Harbor Freight Tools gift card of the total amount of qualifying Harbor Freight Tools purchases shown on a credit or debit card statement
  • A $10 Harbor Freight Tools gift card
Proof of Purchase

Class Members must submit one or more of the following to document their qualifying purchases:

  • An itemized Harbor Freight Tools receipt from purchases between April 8, 2011 and Dec. 15, 2016 that show a “you saved” amount
  • Copies of a credit or debit card statement showing Harbor Freight Tools purchases from between April 8, 2011 and Dec. 15, 2016
  • A declaration signed under penalty of perjury stating that they purchased Harbor Freight Tools merchandise that was advertised with a higher reference price next to a lower offering price, and that they do not have a receipt or card statement documenting that purchase

How much are the checks for TCPA?

    1. John F says:

Got a check yesterday for 419.50

  2. Dean Lester says:

    I got a check in yesterday’s mail.
My claim had a submission for both a check and a gift card, but I got only the check. Did anyone else get their gift card? Or I wonder if that will be sent separately.

    1. Rona says:

How much was your check for?

    2. Megan D says:

In my letter that came with my gift card it says a check will be mailed out separately! Hope this helps!

Final Judgment have been resolved as of March 26, 2018. Disbursements to eligible Class members who did not opt out and who sent in valid and timely Claim Forms will, in most instances, be mailed within 1-3 months from the date the appeals were resolved.

Just curious if this had been resolved yet? I have a certified paper showing my ppw was received as I sent it all by certified mail. It has now been 3 months since last posting here. Do we atleast have updated information?

    Thank you,

    Jessie

    1. Danny says:

What’s the Facebook page? I can’t find one.

  5. David says:

    The time just got extended….
A Notice of Appeal was filled today.

    11/17/2017
Notice of Appeal, Transcript has been ordered, Journal Entry of November 3, 2017, docketing statement, certificate of service, filed. Attorney Larry W. Zukerman CA Number 2017-L-155
Copies of Notice of appeal, all accompanying documents issued to Nicole Fiorelli, Rodger Eckelberry, Judge Culotta and Warren. Postal certificate in file.

The question is, why would you reach a settlement agreement and then appeal what you agreed to. That makes no sense to me.

  6. Susie K says:

On November 3, 2017, the Court granted final approval of the settlement in its Settlement Order and Final Judgment. Please be patient. Payments to eligible Class members who did not opt out and who sent in valid and timely Claim Forms will be mailed in most instances approximately 1-2 months after appeals from the Settlement Order and Final Judgment, if any, have been resolved.

  7. scott says:

I have sent my info in for Harbor freight back on March 17th and haven’t heard anything either . It really would be nice if they could let people know what’s going on or was it a scam and once again the people that pay don’t get paid back.

    1. Top Class Actions says:

The settlement has not been granted final approval. Claims cannot be paid until final approval is granted. That, and it could potentially take the settlement administrator several months to review and process all claims. We are following the case and will let our viewers know as soon as the settlement is granted final approval!

  8. Ralph Bodenner says:

Hello–The official response to my initial Harbor Freight claim (with its detailed receipt copies) was that the data provided was illegible. As a result, I provided all the receipts in their ORIGINAL form, but have gotten no response to that submission. Please provide receipt acknowledgment and an update to my rather significant claim. I provided my new mailing address after moving from Michigan to Florida. It was: 1185 East Lincoln Street, East Tawas, Michigan 48730. It is now: 706 Perez Place, The Villages, Florida 32159. Thank you, Ralph Bodenner, LTC (Retired), US Army. 989.460.7041. bodennerr@yahoo.com.

  9. Jeanne Osbahr says:

Same with me, no response. Is this settled?

  10. Katie says:

    Hello,

I’m wondering if there is any updates as I submitted my claim a very long time ago and tried getting in contact with the national for an update but no one has gotten back to me.

    1. Peter says:

I am in the same situation as you are. It looks like there is no way to verify my submission and no where to contact them.

      1. Katie says:

I tried getting in contact with the National Price Sale Settlement on Facebook. I’m still waiting for them to answer my question if there are any updates as there’s about 100 questions others are asking besides me. They are looking into the paperwork and everything to see if there are any updates. If I get anything, I’ll be sure to post it here.
