Harbor-Freight-Tools

Parties have reached a settlement in a Harbor Freight Tools deceptive pricing class action lawsuit.

Customers who between April 8, 2011 and Dec. 15, 2016 purchased merchandise from Harbor Freight Tools that was advertised with a higher reference price, or “comp price,” next to the actual offering price may be eligible for a settlement payment.

Plaintiff Jeffrey Beck accused defendant Harbor Freight Tools USA Inc. of deceptively promoting its merchandise as being “on sale” or marked with allegedly fictional “comp at” prices used to create the illusion of a discount.

According to Beck, items marked with a “comp at” price were not actually offered for sale at that price for 28 of the preceding 90 days. Beck claimed that Harbor Freight Tools never sells this merchandise at the stated “comp at” prices.

Therefore the difference between the “comp at” price and the actual offering price was a fictional discount designed to deceive consumers, Beck claimed. He argued that this Harbor Freight Tools deceptive pricing violated consumer protection laws.

The settlement does not require Harbor Freight to admit any liability or legal fault, and the court has made no such determination. Harbor Freight maintains it has complied with all applicable laws.

Who’s Eligible

Class Members covered by the settlement include U.S. customers who between April 8, 2011 and Dec. 15, 2016 purchased any product from Harbor Freight Tools that was advertised with a higher reference price adjacent to a lower current offering price, but which was not sold by Harbor Freight Tools at the higher reference price for at least 28 of the last 90 days prior to purchase.

Potential Award

Varies.

Qualifying Class Members have three possible recovery options, depending on how they can document their qualifying purchases:

  • A refund of either 20 percent in cash or 30 percent on a Harbor Freight Tools gift card of the “you saved” amount shown on a Harbor Freight Tools purchase receipt
  • A refund of either 10 percent in cash or 12 percent on a Harbor Freight Tools gift card of the total amount of qualifying Harbor Freight Tools purchases shown on a credit or debit card statement
  • A $10 Harbor Freight Tools gift card
Proof of Purchase

Class Members must submit one or more of the following to document their qualifying purchases:

  • An itemized Harbor Freight Tools receipt from purchases between April 8, 2011 and Dec. 15, 2016 that show a “you saved” amount
  • Copies of a credit or debit card statement showing Harbor Freight Tools purchases from between April 8, 2011 and Dec. 15, 2016
  • A declaration signed under penalty of perjury stating that they purchased Harbor Freight Tools merchandise that was advertised with a higher reference price next to a lower offering price, and that they do not have a receipt or card statement documenting that purchase

UPDATE: The Harbor Freight Tools Deceptive Pricing Class Action Settlement was granted final approval on November 3, 2017.  However, on November 17, 2017, a notice of appeal was filed.  Claims will not be paid until all appeals are exhausted.  We appreciate your ongoing patience.     I shop at Harbor Freight they had a managers special discount sale along with there 3 day parking lot sale I read manager sale I had purchased some of the items 2 days before that was on sale the items was on the managers sale the price was higher I went back during the 3 day sale had the flyer manager price they scanned it I told them it wrong it was like 5.00 lower I had the item number and the code also the item is on the coupon good till june 2017 the checker said I don’t think you are right but I will put the code in guess what it was and I use the 20% off coupon on anything I buy they tell me it wont work because the item is on sale it doesn’t say that on the coupon they put it in and it takes 20% off. they advertised a pressure washer on sale 79.99 I bought it and 5 more items that I found are marked down lower than the sale price after ny coupon and giving the correct price which is lower price than the sale price my total bill with the pressure washer and other items I paid 65.49 which is 15.00 less than the washer advertised on sale it is the same price today. I spend under 20.00 every time I go to harbor freight unless I buy a higher price item use my 20% off coupon plus my free gifts which they have 7-10 free items everyday I go to harbor freight website to get this information if the batteries are on sale 7.99 go pull coupons online harbor freight you will see 4.99 so do the right hand knows what the left hand is doing because I always have a code that is lower that is false advertising even though it saves me lot of money how many people pay the sale price which is not it is higher than the regular price called mark it up to mark it down I caught another department store doing the same I say get harbor freight inline to many conflicting prices I have proof to show it

    If you did the homework that I did on HF deceptive pricing, you would not be stating what you said in the comments. I have found thousands of items with false data, prices, etc., on all HF items. If you want to see deception, check on the flyers that issues. 80%nof the items shown are repeat items listed at different prices, and if you look very carefully, the flyer ads says “sale for 3 days” for example March 19 to 21, 2017, but if you look under the item comment, it will list a comment “good until (for example) May 30, 2017. HF will show an item, but it is the wrong item, HF shows trailers, but if you look closer, the 2 trailers, under different item number and prices, are the same trailer. There are hundreds of items like these in their catalogs.

    What a joke! The ONLY people that gain anything here are the lawyers. According to the settlement docs, as much as $10,000,000 of the $23,000,000 paid by HF can be claimed by the lawyers.

    What type off lawsuit is this ,so the money is going right back in their pocket ,they giving you a habor freight gift card so basically they not losing out ,what a bunch of crooks and the judge let this happen.

        Yea, what a bunch of crooks! They forced you to buy the merchandise, huh? Listen if you pick up an item and go to check out; if the price is different or did not get discounted DO NOT BUY IT!!!!!!!!!!!!. YOU have the option to walk out without buying anything.

        Harbor Freight is a great place to shop. When you have lawsuits such as this, eventually the price will go up, to pay for lawyers. That price gets passed on to you the customer.

          Well said Tyrone! Couldn’t agree more. Many stores do that, Kohl’s, all of the outlet stores, etc. It’s called retail…they don’t stay in business losing money!

          But, this, is still not a slap on the wrist for harbor freight. They still are not even using computers for some reason to make shure their advertised sales are honored. Even their membership discounts are not applied. I been promised by managers that all my items were discounted. A week later, boom, I have to keep going back n get my adjustments on several items. They blame this n that, but what about all the other people who don’t realise this. It has to be they are playing dumb, till they get caught. They need to have more than a smack on the wrist.

      People were given the option to get cash or a gift card, if you didn’t have receipts but had credit/debit card statements you could get 10% cash back or 12% gift card, it makes sense for some people to take the gift card if they were just going to spend the money right back at HF, that way they get an extra 2% and HF also comes out ahead.

    Is sad to see where america has ended up at, I do buy at harbor freight and I do believe is no fair for the store to get this type of lawsuits, they sell great items at great prices and if you don’t like it don’t buy there, but a lawsuit is just plain stupid!!!!!!!!!!

      I hate to see this lawsuit!! It’s a place for the do it yourself person. I love there 20&25% coupons on single item. There price cheap, but the warranty on the products to me double its value. I see the same identical products at some other top brand companies sell for 3-4x the price of Harbor Freight. This is how companies go under. Again there not selling these products at the price of some of there competition!!!

    So if I am reading this correctly, if you don’t have a receipt, you must MAIL in the claim form?? Is that correct??

      Yep…cuts down on all the bogus easy to get fraudsters that never shopped at the store and don’t care to lie under oath via an online click. More of these lawsuits should be this way. If people were required to buy a stamp and fill something out by hand and swear to it, there might not be so many people clamoring for $10

      JD, yes you are correct. BUT- When you print out the claim form, an do not have any receipts, your only option is 1 $10.00 gift card. Which is totally different information stated in the online options. I agree with most folks here. Just the lawyers & judges will make money on this suit.

        While that is not untrue how would any reasonable measure be made otherwise, and this does provide a deterrent against false advertising. I, personally, don’t give their “compare to” claims much weight as it is highly variable, subjective and everything is not exactly equal in all areas. I do not backcheck the claims but find them not to be too unreasonable. I do think this case is questionable. A local supermarket near me often claims a “Hot Deal” while I find that to be the regular price (which in itself is big too bad anyway. It does bother me a bit, and I do wish they really wouldn’t do that. Anyway, I’ll probably try and get whatever I can due to the atmosphere of the times. –Regretfully, I’ve become bitter about the integrity of fair trade, lawyers, “rights”, entitlements, loyalty and greed. I have heard several other rumblings over the past half decade of “I’m out for myself now” –such a great second half of my life thus has turned into ¡
