Harbor-Freight-Tools

Parties have reached a settlement in a Harbor Freight Tools deceptive pricing class action lawsuit.

Customers who between April 8, 2011 and Dec. 15, 2016 purchased merchandise from Harbor Freight Tools that was advertised with a higher reference price, or “comp price,” next to the actual offering price may be eligible for a settlement payment.

Plaintiff Jeffrey Beck accused defendant Harbor Freight Tools USA Inc. of deceptively promoting its merchandise as being “on sale” or marked with allegedly fictional “comp at” prices used to create the illusion of a discount.

According to Beck, items marked with a “comp at” price were not actually offered for sale at that price for 28 of the preceding 90 days. Beck claimed that Harbor Freight Tools never sells this merchandise at the stated “comp at” prices.

Therefore the difference between the “comp at” price and the actual offering price was a fictional discount designed to deceive consumers, Beck claimed. He argued that this Harbor Freight Tools deceptive pricing violated consumer protection laws.

The settlement does not require Harbor Freight to admit any liability or legal fault, and the court has made no such determination. Harbor Freight maintains it has complied with all applicable laws.

Who’s Eligible

Class Members covered by the settlement include U.S. customers who between April 8, 2011 and Dec. 15, 2016 purchased any product from Harbor Freight Tools that was advertised with a higher reference price adjacent to a lower current offering price, but which was not sold by Harbor Freight Tools at the higher reference price for at least 28 of the last 90 days prior to purchase.

Potential Award

Varies.

Qualifying Class Members have three possible recovery options, depending on how they can document their qualifying purchases:

  • A refund of either 20 percent in cash or 30 percent on a Harbor Freight Tools gift card of the “you saved” amount shown on a Harbor Freight Tools purchase receipt
  • A refund of either 10 percent in cash or 12 percent on a Harbor Freight Tools gift card of the total amount of qualifying Harbor Freight Tools purchases shown on a credit or debit card statement
  • A $10 Harbor Freight Tools gift card
Proof of Purchase

Class Members must submit one or more of the following to document their qualifying purchases:

  • An itemized Harbor Freight Tools receipt from purchases between April 8, 2011 and Dec. 15, 2016 that show a “you saved” amount
  • Copies of a credit or debit card statement showing Harbor Freight Tools purchases from between April 8, 2011 and Dec. 15, 2016
  • A declaration signed under penalty of perjury stating that they purchased Harbor Freight Tools merchandise that was advertised with a higher reference price next to a lower offering price, and that they do not have a receipt or card statement documenting that purchase

UPDATE: The Harbor Freight Tools Deceptive Pricing Class Action Settlement was granted final approval on November 3, 2017.  However, on November 17, 2017, a notice of appeal was filed.  Claims will not be paid until all appeals are exhausted.  We appreciate your ongoing patience.     When a company sells a “kit”, what does that imply? To me it means everything included. HF solar kits have 2 main components not included. And would not return the items even unopened w/receipt. That was 3 years ago. I used to spend a lot of money there. But not since the solar kits.

    Are you kidding? Like, I saved my receipts for the THOUSANDS OF DOLLARS worth of stuff from there? Gimme a break!

    Must be making big money to open a new store every day. Stealing others patients. My generaters gas tank leaked, right on the exhaust, didn’t won’t to refund or exchange, could not believe it. Thay were told the generater was in my moterhome, could have burned down. Went home with a leaking gas tank

      I’ve got every receipt back to 2001. Between April 2011 and December 2016 I spent over $4,500 at harbor Freight. I would likely qualify for over $1,000 in store credit. I’ve always been treated fairly by this company and you can’t beat the prices they offer. There are a few companies out there that I would love to recoup money from but Harbor Freight isn’t one of them. Too bad we couldn’t start a class action against the b****rds that started this suit. I won’t be asking for any money back…only hope it doesn’t have a major effect on their business.

    I don’t know where my receipt is. And we got lots of things from there.. and if I claim the stuff. And every one too isn’t the place going to fold, or raise prices

    I think all the free stuff Harbor Freight gives away more than makes up for filing a class action lawsuit. Also, the “comp at” or “compare at” reference doesn’t necessarily refer to their own merchandise. It could mean “compare at” anywhere.

      I worked for them this past year and quit because of the unlawful couponing. they want to make you think you’re getting the best deal and then try to put your “savings” towards a store membership, that really is just more coupons that don’t change… ever. every month the same things are on sale, I’ve had to study the catelogs every months and every so often will it skip a month for a sale but def not as long as 90 days. they reword everything and always have huge sales going on to make you think your getting a better deal so you don’t buy somewhere else. it’s ridiculous.

    There are a lot of companies out there doing the same thing. Why is everyone so willing to jump on the lawsuit bandwagon at the drop of a hat? It just gets passed on to consumers. There are a lot of other companies out there who treat consumers far worse and get by with it because they have unscrupulous attorneys craft agreements that strip consumers of the right to fair recourse.
