Ferrara Candy Company agreed to pay $1.5 million to settle a class action lawsuit that accuses the business of discriminating against potential workers simply because they are African-American.
Plaintiffs Brian Lucas, Aronzo Davis, Torrence Vaughans and Maurice Milton filed the class action lawsuit on behalf of themselves and all others seeking employment at the Ferrara Candy Company, either directly or through two staffing agencies known as Labor Power and REM.
According to the lawsuit, the company limited or completely excluded African-American workers from being hired by Ferrara for positions of Machine Operator, Mogul Cook, Engrosser, Janitor, Quality Control Technician or Shipping Clerk.
The plaintiffs claim that they were steered away from available jobs at Ferrara by the staffing agencies who instead hired Latinos for those positions.
Ferrara, Labor Power and REM denied all allegations of wrongdoing but decided to settle the class action lawsuit to avoid the cost of further litigation.
Who’s Eligible
The Ferrara Candy class action settlement is open to all Ferrara Direct Applicant Class Members and all African-Americans who sought a work assignment through REM or through Labor Power and were otherwise eligible to work at Ferrara but were not assigned or hired to work at the company between Feb. 27, 2009 and Dec. 22, 2015.

UPDATE 4: On Dec. 2, 2016, the court granted the Ferrara Candy Company settlement final approval. Â There is a 30 day period in which appeals can be filed. Â Claims will not be paid until after the appeals period expires, and there are not any appeals filed. Â Please keep checking Top Class Actions for updates. Being grateful is a learned process that younger people have not been taught. Most employers will fight against giving a reward because of their wrong doing. However discovered, believe it or not the reward was recompense. You see i went on to gain employment as logistic clerk for Amazon. Did any of you move on to become gainfully employed or are you stuck thinking someone owes you something? For the ones that received rejection letters. Do you seriously believe Fererra had no records indicating that you came no where near the place looking for a job? Move on.

call lawyer office today (312-795-9121) concerning denied letter recvd and why,i was told on letter I was denied due to late returning w-9/w-4.my name was placed on this list where they are sending letters out again.please call this number and complaint about your claim.(stand for your rights)the more call it will cause for everyone that was denied to get their payments,its not over yet.good luck everyone.
Have anyone had problems cashing their checks? I went to Walmart and a check cashing place and BOTH declined to cash the check. At the check cashing place the gentleman said he had to wait to Tuesday to call and confirm the check. This is crazy. So I have 900.00 in my hand and can’t get it cashed. Wow!
i did get a decline and my bank had to hold it becaus ethey never heard of that bank…. blah

So today, I received a knock on my door, it was my neighbor, she handed me my check that was accidentally placed in her mailbox by our incompetent mail carrier. It was for 904.82. I couldn’t believe it. This check could have been lost and I would have had a tough time trying to track it. I don’t even care for my neighbor, but she was nice enough to bring it over unopened. I plan on giving her a small amount for her good deed and for looking out for me. Although I’m thankful for the amount, it seems as if we should have gotten more since so many people were denied.

The wait is over.I live in Chicago.I received my check today,at appox 11am ,my appox.daily mail run. Check amount is $904.82.
I called today, 1-13-2017, the 312-795-9120 number to check my status, since so many people in the comment section was saying they had been denied. I hadn’t received a denial letter, but my friend did, so I wanted to know what was going on. Talked to a lady today and she confirmed I was being sent a check. I never asked the amount. She confirmed my address and telephone number and said the checks were mailed out Tuesday and they are coming from Seattle Washington. Can’t wait!!! I live in Kentucky.
You would think that if so many people were denied payment, the amount for others would be higher.
