The Ferrara class action settlement resolves allegations that the candy company refused to hire African-American workers for available positions including Machine Operator, Mogul Cook, Engrosser, Janitor, Quality Control Technician or Shipping Clerk.
Plaintiffs Brian Lucas, Aronzo Davis, Torrence Vaughans and Maurice Milton filed the class action lawsuit after allegedly being steered away from jobs at Ferrara by the staffing agencies REM and Labor Power.
The plaintiffs say Ferrara’s workforce assigned by REM and Labor Power was “overwhelmingly Latino.” By filing the class action, the plaintiffs hoped to recover lost wages that they could have received if Ferrara would have hired them.
Ferrara, Labor Power and REM denied the allegations but agreed to pay $1.5 million to settle the claims and avoid the risk and cost of further litigation.
Class Members included “all African Americans who sought a work assignment through REM or through Labor Power and were otherwise eligible to work at Ferrara or who were Ferrara Direct Applicant Class Members but, on one or more occasions, were not assigned or hired to work at Ferrara in such capacity during the period of February 27, 2009 through the December 22, 2015 Approval Date.”
The deadline to file a claim for the Ferrara job applicant settlement passed on May 3, 2016.

Never received my check
I never recived mine
Informed delivery via USPS has two letters labeled “important tax documents” postmarked 1/24 from this settlement…anyone know what this is for? I haven’t received a check yet
I have one coming as well I’m wondering what it is
What are you black folks complaining about> I am white and I didn’t get mine. I swear if I had a time machine< I'd go back and tell my lazy ancestors to pick their own cotton, that they are ruining the future.
David Duke,
By you being white, you would not have been apart of this settlement. READ THE FINE PRINT!

Did you get tax forms prior?
Yeah they didn’t even check records for previous applications, you just had to fill out the forms correctly to get the money.
And you would know this HOW again? Cases like this one are happening EVERYWHERE.
So I was denied because I filled out the W2 wrong. BIZARRE. Yes, Lorenzo Canada jr. posted online that he got a check but also posted that he got many checks in the past – like Korean air also? what a coincidence. I am sure he flew to korea multiple times and also failed to get hired for being African American. so legit claims got denied while people boast about the multiple claims they filed and were paid.
