ferrara wage and hour class action lawsuit settlement

Ferrara Candy Company agreed to pay $1.5 million to settle a class action lawsuit that accuses the business of discriminating against potential workers simply because they are African-American.

Plaintiffs Brian Lucas, Aronzo Davis, Torrence Vaughans and Maurice Milton filed the class action lawsuit on behalf of themselves and all others seeking employment at the Ferrara Candy Company, either directly or through two staffing agencies known as Labor Power and REM.

According to the lawsuit, the company limited or completely excluded African-American workers from being hired by Ferrara for positions of Machine Operator, Mogul Cook, Engrosser, Janitor, Quality Control Technician or Shipping Clerk.

The plaintiffs claim that they were steered away from available jobs at Ferrara by the staffing agencies who instead hired Latinos for those positions.

Ferrara, Labor Power and REM denied all allegations of wrongdoing but decided to settle the class action lawsuit to avoid the cost of further litigation.

Who’s Eligible

The Ferrara Candy class action settlement is open to all Ferrara Direct Applicant Class Members and all African-Americans who sought a work assignment through REM or through Labor Power and were otherwise eligible to work at Ferrara but were not assigned or hired to work at the company between Feb. 27, 2009 and Dec. 22, 2015.

I got a letter in the mail today with forms to send back in….tax stuff….and Medicare forms

    1. Dave G says:

I received the same letter – Do we need to complete this since the suit is not really about Medicare but job discrimination? I do not feel comfortable giving them all of this private information.

      1. Sharon Styles says:

You will have to fill out the forms in its entirety or you will not get paid. If you receive or received any kind of medicare, they are implying medicare would get paid also

  2. redtkn says:

Just spoke with the district court, they said that that they were granted reasonable attorneys fees and it was continued for final court date on 7/21/16, so far no appeals were filed .

    1. Chelle says:

I thought June 2 was the final court date

  3. Brian says:

    Nope

  4. Dana Worthington says:

Since this is not even your real name, I am gonna take a leap and say that your are pathetic and small and need to go elsewhere with your ignorant comments. Oh and possibly you should go back to school, earn a high school diploma ( at the very least) and learn that your behavior behind your computer screen is indication of a person with a sick mind and feeble thoughts.

  5. Dana Worthington says:

As long as there are humans like you hiding behind a keyboard spewing their ignorant thoughts, there will ALWAYS be a need for all minorities, including women of any color, to have to file lawsuits against companies of this ilk. You are a sad little person.

  6. Trich says:

Good,- in Houston some of these companies especially the ones that have are mexican owned or have a lot of mexican workers discriminate against black workers and only want to hire their own and they love saying they only have bilingual jobs. Get that money $$

  7. Sharon Jones says:

I am definitely going to file for this class action lawsuit; discriminating against someone because they are afro American or any minority is an injustice and wrong.

  8. latoya says:
