Ferrara Candy Company agreed to pay $1.5 million to settle a class action lawsuit that accuses the business of discriminating against potential workers simply because they are African-American.
Plaintiffs Brian Lucas, Aronzo Davis, Torrence Vaughans and Maurice Milton filed the class action lawsuit on behalf of themselves and all others seeking employment at the Ferrara Candy Company, either directly or through two staffing agencies known as Labor Power and REM.
According to the lawsuit, the company limited or completely excluded African-American workers from being hired by Ferrara for positions of Machine Operator, Mogul Cook, Engrosser, Janitor, Quality Control Technician or Shipping Clerk.
The plaintiffs claim that they were steered away from available jobs at Ferrara by the staffing agencies who instead hired Latinos for those positions.
Ferrara, Labor Power and REM denied all allegations of wrongdoing but decided to settle the class action lawsuit to avoid the cost of further litigation.
Who’s Eligible
The Ferrara Candy class action settlement is open to all Ferrara Direct Applicant Class Members and all African-Americans who sought a work assignment through REM or through Labor Power and were otherwise eligible to work at Ferrara but were not assigned or hired to work at the company between Feb. 27, 2009 and Dec. 22, 2015.

UPDATE 4: On Dec. 2, 2016, the court granted the Ferrara Candy Company settlement final approval. Â There is a 30 day period in which appeals can be filed. Â Claims will not be paid until after the appeals period expires, and there are not any appeals filed. Â Please keep checking Top Class Actions for updates. If the money is divide equally how are we getting $904. That mean over 950 people are getting checks. A lot of this stuff u guys are saying don’t add up but I’m going to wait and see.

My spouse received his check today in the amount of $904. Can’t post a pic up here but will try to upload one on fb. I tried to copy and paste an image and it’s not working. They taxed half of the original amount of $959. We are in Virginia now.

Well it’s true. No need to lie. Tried to post picture of stub up here. Half counted as unpaid wages. The total amount of the check was $959 minus the SS, Medicare taxes and state taxes. Net amount of check is $904. 82. Checks are coming from Seattle Washington.

this is the saddest class action settlement that I have ever seen in my life.what kind of lawyers are they,and what type of court accept pre-k documents.every denied letter I have read from these comments, not one made sense.this is a insult to our intergent.i hoped that everyone that filed was approved.sorry this happen to us.as I read the comments I can feel the disapointments in so many.its over and time for us to just move on.and for the ones that was approved,i am happy for you.
It’s makes no sense to me that I was sent a claim form by the law firm handling the lawsuit (OUT THE BLUE). I applied directly threw the company and never received a responds. I actually forgot I applied for the job, I knew nothing about this lawsuit until the law firm sent the claim form so I find it odd that I was eligible to be part of the suit but NOT eligible to be compensated once the settlement was approved. I think all that was denied really need to look into the reasons why we were denied if if claim forms were sent in before the deadline AND especially if a claim form was sent to us by the law firm and NOT REQUESTED because it’s obvious that the lawyers got the company records and seen who applied for a job but was not hired or contacted

I Agree!!!. I spoke to a guy today. He said the checks were mailed Tuesday and is coming from Seattle Wash. He has it depends on your mail when the checks will be delivered. He said they did go out Tuesday.
