citibank call recording settlement

Citibank NA agreed to pay $1.55 million to settle a class action lawsuit stemming over allegations that the banking giant listened-in on customer phone calls made to its toll-free line, without informing callers that they were being recorded.

Plaintiff Ramona Edery filed the Citibank lawsuit after making a call to the toll-free number in order to open an account. She claims to have discussed private financial information during that phone call and only later discovered that the conversation had been recorded.

Edery alleged Citibank violated California’s Invasion of Privacy Act and referred to a state Supreme Court ruling that found customers are used to being told about any recording or monitoring at the beginning of a phone call so she had a reasonable expectation that the information she shared was not being recorded.

Those who wish to object or opt-out of the class action settlement must do so by July 28, 2016.

Who’s Eligible

Class Members include all California residents who participated in one or more phone conversations with Citibank at 800-745-1534 and were recorded or monitored without being informed between Apr. 3, 2013 and May 15, 2013.

Potential Award

$350 – $2,500

The Citibank Settlement Fund of $1.55 million will be divided among Class Members who file valid and timely Claim Forms after court expenses are paid off. The Settlement Administrator estimates that this will give each Class Member between $350 and $2,500, depending on the number of claims.

Anyone know when checks will be mailed?

    1. Debbie says:

      Website updated today.

  2. Lisa says:

When you received the letter from Citi did it just include the w-9 form and nothing else because i got just a w-9 form.

    1. Brian says:

Yes it’s just the W-9 form required when a claim payment is large so just fill it out ASAP and mail it back. It means your claim accepted.

      1. Allen Payne says:

If you don’t mail it back in they will take taxes out of your settlement

  3. sharon says:

If you do not receive a W-9 that means your claim was denied?

    1. Top Class Actions says:

You should contact the settlement administrator with any questions about a claim you submitted. We wish you the best of luck, and please keep us posted!

  4. Kay says:

One of the documents says $2350 and another says $2263, there were 410 valid claims…so we are getting over $2000 each, which is more than I ever expected from this!
Cant wait for my check! Hope all who are waiting for checks will get one! I also got a tax form from Rust over the weekend so Im excited!
    Thanks Top Class Actions!

    1. Bobby says:

Where did you find this 410 valid claims number?

  5. Jenn says:

Yahoo! I’m so happy it’s true and others have been able to find the same court documents. This is a good payout.

  6. George says:

Yes I looked up on court website, states payment will be 2263, although not sure how many claims are valid

  7. DDM says:

I just received an IRS Form W-9 from the administrator asking me to fill it out and return by October 14, 2016. If not, State and Federal taxes will be withheld. I will be sending it back tomorrow. Clearly this payout is over $599. I’m in California

  8. TANJA ROBERTSON says:

what love and jenn says ….might be true ….the math adds up …….it would be sweet …..asking for the tax form ….means over 600 …… i looked and could not find that info ….

    1. Mike Smith says:

      Jenn is correct $2263!

  9. Mike Smith says:

    What court documents
    Dont see them?

    1. Jenn says:

If you go to the website above and view the PDF document about the case then one of the questions shows a link for more info. I was able to search for the case number and found it. Not sure how someone above found different info on a website.

  10. Jenn says:

I just read the court documents and it estimates the payment will be $2,263 per valid claim.

    1. Karen says:

Yes Jenn, what you say is absolutely true. I also read the same information on a court document that was filed on September 15th in Superior Court of California, San Francisco and it mentioned Rust receiving over 25,000 claims, most of the claims invalid, and each estimated valid claim is worth $2263 each. I am so excited to be a part of this one!
