Caribou-coffee

Caribou Coffee Inc. has agreed to settle a class action lawsuit alleging it violated the Telephone Consumer Protection Act by sending text messages to mobile phone numbers without the prior express written consent of the recipients.

If you received one or more text messages from Caribou Coffee between May 5, 2012 and July 28, 2017, you may be entitled to a cash payment from the TCPA class action settlement.

The Telephone Consumer Protection Act is a federal law that restricts telephone solicitations and the use of automated telephone equipment to make phone calls and send text messages. Under the TCPA, businesses are prohibited from sending marketing text messages and other types of phone messages without the prior express written consent of the recipient.

Plaintiff Kristie Farnham alleges that she received approximately 50 text messages from Caribou Coffee beginning in March 2016. She maintains she never provided her express written consent to receive such communications.

According to the Caribou Coffee TCPA class action lawsuit, the text messages were sent using an automated telephone dialing system that is capable of making numerous calls and/or texts simultaneously.

Farnham’s Caribou Coffee class action lawsuit sought statutory damages of $500 to $1,500 for each text message that violated the TCPA.

Caribou Coffee denies the allegations but agreed to settle the TCPA class action lawsuit to avoid the burden and expense of ongoing litigation. In addition to providing compensation to eligible Class Members, Caribou Coffee has also agreed to discontinue its text message marketing programs.

Class Members who would like to opt out of or object to the Caribou Coffee settlement must do so no later than Oct. 13, 2017.

Who’s Eligible

Class Members include anyone residing in the United States who, between May 5, 2012 and July 28, 2017, received one or more text messages sent to their cell phone number by or on behalf of Caribou Coffee.

Potential Award

To be determined. The Caribou Coffee settlement fund will be distributed on a pro rata basis to all Class Members who submit timely and valid claims. The amount each claimant will receive depends on the total number of valid claims filed.

Proof of Purchase

N/A. Class Members must provide the cell phone number that received the unwanted text messages from Caribou Coffee and declare under the penalty of perjury that they received at least one text message from Caribou between May 5, 2012 and July 28, 2017.

    People be aware… more and more these administrators are refusing payout, claiming, (untruely) that they sent an email for further clarification, which was not replied to. And these particularadministrators are some of the worse. Perhaps we should all file objections to the settlements and inform the courts of the illegality being carried out by these crooks!!!
