Caribou-coffee

Caribou Coffee Inc. has agreed to settle a class action lawsuit alleging it violated the Telephone Consumer Protection Act by sending text messages to mobile phone numbers without the prior express written consent of the recipients.

If you received one or more text messages from Caribou Coffee between May 5, 2012 and July 28, 2017, you may be entitled to a cash payment from the TCPA class action settlement.

The Telephone Consumer Protection Act is a federal law that restricts telephone solicitations and the use of automated telephone equipment to make phone calls and send text messages. Under the TCPA, businesses are prohibited from sending marketing text messages and other types of phone messages without the prior express written consent of the recipient.

Plaintiff Kristie Farnham alleges that she received approximately 50 text messages from Caribou Coffee beginning in March 2016. She maintains she never provided her express written consent to receive such communications.

According to the Caribou Coffee TCPA class action lawsuit, the text messages were sent using an automated telephone dialing system that is capable of making numerous calls and/or texts simultaneously.

Farnham’s Caribou Coffee class action lawsuit sought statutory damages of $500 to $1,500 for each text message that violated the TCPA.

Caribou Coffee denies the allegations but agreed to settle the TCPA class action lawsuit to avoid the burden and expense of ongoing litigation. In addition to providing compensation to eligible Class Members, Caribou Coffee has also agreed to discontinue its text message marketing programs.

Class Members who would like to opt out of or object to the Caribou Coffee settlement must do so no later than Oct. 13, 2017.

Who’s Eligible

Class Members include anyone residing in the United States who, between May 5, 2012 and July 28, 2017, received one or more text messages sent to their cell phone number by or on behalf of Caribou Coffee.

Potential Award

To be determined. The Caribou Coffee settlement fund will be distributed on a pro rata basis to all Class Members who submit timely and valid claims. The amount each claimant will receive depends on the total number of valid claims filed.

Proof of Purchase

N/A. Class Members must provide the cell phone number that received the unwanted text messages from Caribou Coffee and declare under the penalty of perjury that they received at least one text message from Caribou between May 5, 2012 and July 28, 2017.

    I got some perks messages like 3 of them in 2014? How do I know whether they were without my consent? Furthermore, what if they in their “terms and conditions” for joining the perks program took the permission to send text messages? Should I file a claim? Furthermore, more importantly I love caribou. Caribou has helped me a lot to perform better at what I do!!!! I was just curious!!

    Thanks for ruining it for the rest of us! I used to get buy one get ones all the time from caribou. I don’t any more, and I’m guessing it’s because of this! People sue over everything these days. And of all the places to sue! If you were suing a collection agency or some other awful thing I would be fine with it. But caribou?their coffee has helped me and many other hospital staff make it through 16 hour shifts and a lot of us miss their text messages!

      I still get buy one get one. I use the Caribou app on my phone to check my rewards. I get emails too. You don’t need a text to know if there are “perks.” I get perks from other places too, without the annoying text. I did not mind the texts, but I could see how it may bother others. Your Caribou perks will live on. You just have to take a few more seconds of your life to find out without a text.

    Sounds absolutely ridiculous. According to the legal notice I received, the attornies will rake in about $3 million. I wonder if the law firm is dedicated to beating the bushes for class actions, and they finally found their rep in Ms. Farnham. Caribou isn’t a giant like Starbucks. This will hurt them. Does this firm also rep Starbucks?
    Sick what people will try to ruin a company over. I wonder what the big picture is? Caribou supports fair trade. Who benefits by hurting Caribou? Monsanto? This may sound conspiracy theoretical but there is usually an agenda.
    I am a member or Caribou’s perks club and they don’t harass people. What do the texts say? Buy one get one free on Wednesday?
    Wish this level of effort could go towards actually helping people.

      Texts don’t bother me, but Caribou was the only place I do rewards with that sent me texts. Some people don’t like texts without their permission. I like Caribou but they were wrong here. If you get some money, make sure you use it all at Caribou. Give it back to the company.

    I have told friends and family leave message I will call back.Even after texting stop still get from some companies. The phone calls are ridiculous and constant if I answer will hang up or won’t listen when you say no take off list most time end up hanging up on them. then someone else calls later different number even when blocked. How do you find out if any are from Caribou?

    actually no because if you were getting them you would know, they were not stopping, lol, in fact once you text “stop”, I received more texts from different numbers actually, and even blocked them and then they just kept coming from other locations. clearly people don’t just “get money” from a judge for no reason, it isn’t that easy please don’t say stupid things you sound like an idiot…. its called harassment, which is what the company was doing….and that is why these companies get in trouble, caribou is not the only one. Also, did the customers SIGN UP for the texts or not??? That makes a huge difference…no company has the right to randomly text anyone to get business, I mean I have to be bothered with commercials and pay for texts that are unwanted and then further have to text the word STOP to make them stop? you can’t be serious, you are joking right….thank god for free speech….

    I agree with Sarah Crosby- why not just text STOP to that number if you don’t want the text? I object to this class action suit against Caribou Coffee, and I want to opt out of it. It would be different if people were seriously harmed by this! Signed, Susan Christopherson

    I don’t get it. It clearly states at the bottom of each text that if you want the messages to stop you text STOP to that number. Seems like someone is just trying to get money.
